As I have denounced since day one, SPAK's actions against journalist Elton Qyno have been outside any international standard, illegal and contrary to any legal and constitutional rule. Time and the Constitutional Court proved me right, as today it declared illegal all the actions of prosecutor Altin Dumani, Behar Dibra and their soldiers at SPAK, as well as judge Atalanta Zeqiraj against journalist Qyno.
The court ruled with 8 votes in favor and none against in favor of journalist Qyno, declaring illegal: his holding hostage in the SPAK premises for 10 hours, the personal search of him, the search of his apartment, the searches of his workplace and vehicle, the seizure of all work tools, including his phone, computers, USBs, CDs and even his children's toys.
So, according to the Constitutional Court, SPAK has committed complete illegality by terrorizing Elton Qynon and his family in the name of seeking the source of information. This decision is a strong blow to the head of the Special Prosecution Office Altin Dumani and his “soldiers”, prosecutors and media “experts” who advise him. The decision is a clear message: SPAK and its “experts” have no right to decide what is news and what is in the public interest.
A real journalist, one with dignity and professional responsibility, does not need to seek permission from the prosecutor's office to report the truth. This decision is a slap in the face to all journalism associations that are running after funds, but did not come to the defense of journalist Qyno, treating his case as a personal problem and not as a serious threat to the entire media.
Also, this decision is a shock to some of my colleagues in the newsroom, who unfortunately rubbed their hands over what happened to Qynos and did not see fit to come out in support of him, but instead continued their servility towards Dumani and the SPAK institution and its "experts". How do you feel now?
But you must understand one thing: Qynos's fight was not only for himself, but also for you. Because tomorrow your turn would come. Therefore, rejoice and celebrate that there are still judges who know how to read and interpret the Constitution, the role of the journalist and the fundamental right to a free media.
This is a victory for all of you, but don't forget to apologize to Qynos for your indifference! Altin Dumani and his "soldiers" should also give a big apology, who have violated the Constitution with their illegal actions. In a normal state, he and others should be held responsible for this serious act of violating the fundamental law of the state and not hide behind the windows of SPAK waiting for three days to pass for everything to be forgotten.
Because they are precisely the ones who exploited journalist Qyno's materials to use them against him, to the point of filing a scandalous accusation, which has now been completely overturned by the Constitutional Court's decision!
