Personally, I was among the few voices that demanded the confrontation of former Deputy Prime Minister Arben Ahmetaj with the law. Not to be mentally satisfied that an official must necessarily go to prison, but because a standard must be set in relation to the law and equality before him. But equality before the law should not be turned into an end in itself, to arrest and accuse, judge or punish people without evidence just because there is a public thirst, so that someone becomes a victim and "the devils laugh" and the people have fun or fill the gluttony with lynching trials against an individual, because then we don't know where everyone's right begins and ends, we don't know if we are in a democracy or a dictatorship, where decisions are made by emotion and not objectivity, Maliqi makes them, not the law.
Having said that, Arben Ahmetaj was finally summoned by the "SPAK" Special Prosecutor's Office, as far as is known as a person under investigation. Ahmetaj himself calmly entered and calmly left the glass building, which produces an extreme coldness even in these hot summer days. Television studios immediately buzzed with the news of the day. To build up to the sensational news, conflicting and mostly speculative reports flowed in. Others say that SPAK is using double standards in relation to some officials, claiming security measures that do not match the responsibility and also the dangerousness of the person under investigation. But what do the facts show so far about Arben Ahmetaj?
1) SPAK has Arben Ahmetaj under investigation, but not under accusation. If he had been charged, he would have communicated a security measure, or how he will be investigated and in what status he will appear before the prosecutor's office.
2) The fact that Arben Ahmetaj went, was questioned and gave explanations to SPAK prosecutors about the incinerators and everything else related to this process, his activity as a member of the government and his wealth, does not automatically put him under accusation and criminal liability. Ahmetaj continues to enjoy all rights as a free citizen of the Republic of Albania.
3) Prokurorëve të SPAK-ut i takon të provojnë me fakte, jo me hamendje apo dëshirat tona implikimin e Arben Ahmetajt në procesin e skemës së inceneratorëve. Nëse nuk e provojnë këtë lidhje e cila mesa duket deri sot nuk është provuar se mungojnë provat mes lidhjes shkak/pasojë të vendimeve të Ahmetajt në pozitën e tij zyrtare, do të thotë se ai nuk mund të merret si i pandehur dhe nën akuzë përveç rastit kur ai është bërë shënjestër e kurbanit politik që dikush është i interesuar të bëjë në emër të drejtësisë.
4) Nëse Arben Ahmetaj vihet pa prova nën akuzë dhe me deduksion dëshirash nga grupe interesi, atëherë kjo nuk është më drejtësi, por gjueti, gjueti shtrigash. Dhe SPAK-u rrjedhimisht del se nuk po vepron si prokurori publike, por si prokurori private, në interes të klaneve politike.
5) Nëse do të vendosej në pozitë penale Arben Ahmetaj, atëherë para tij në bankën e drejtësisë dhe në derën e prokurorisë do të duhet të shkojë Edi Rama si titullar i qeverisë. Promovimin dhe mbrojtjen e inceneratorëve me shumë se kushdo e bëri dje dhe vijon ta bëjë edhe sot Edi Rama, jo Arben Ahmetaj. Firmat në vendime fap, fap, fap nuk i ka hedhur Arben Ahmetaj, por Edi Rama. Atëherë përse qenka i fajshëm Arben Ahmetaj dhe jo Edi Rama?!
Pretenca politike që Edi Rama i bëri bashkëpunëtorit të tij më të afërt për shumë vite më radhë në mënyrë parakohshme ishte mënyra më e gabuar për të hedhur dritë e bërë drejtësi për inceneratorët. Ishte një orientim i qëllimshëm në rastin më të keq e i nxituar në rastin më të mirë. Tani SPAK-u ndodhet para një sprove të rëndësishme të integritetit profesional dhe ligjor, ku duhet të tregojë se prova dhe vetëm prova është ajo që duhet, për të bërë e dhënë drejtësi. Nëse nuk është në gjendje të provojë me fakte fajësinë e çdo individi sipas përkatësisë në çështjen e inceneratorëve, atëherë duhet të shfaqë integritet institucional dhe profesional për të treguar se jemi në demokraci e jo të komandokraci, ku çfarë kërkon populli, bën partia e çfarë thotë partia bën populli. SPAK-u nuk mund të sillet, as si popull, as si parti politike, apo strukturë politike e komanduar nga kombëtaret apo ndërkombëtarët. SPAK-u duhet të komandohet vetëm nga ligji dhe të veprojë vetëm në bazë të ligjit. Çdo akt tjetër nuk është më gjykim penalist, por gjykim populist.
