The Criminal Court of Kosovo announced the verdict for members of a structured criminal group accused of drug trafficking.
The Criminal Court of Appeals ruled for Aleks Nanaj (alias Adil Nano), Emiljant (Emiljan) Lamkollari, accused of committing the criminal offenses "Trafficking in narcotics", more than once, committed in collaboration in the form of a structured criminal group, "Structured criminal group" and "Committing criminal offenses by a criminal organization and a structured criminal group" and Pashk Syla, accused of committing the criminal offense "Production and sale of narcotics" committed in collaboration, provided for by Article 283/2 of the Criminal Code.
ANNOUNCEMENT from SPAK
1. The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject matter: “Sending to trial the criminal case against the defendants Aleks Nanaj (alias Adil Nano), Emiljant (Emiljan) Lamkollari, accused of committing the criminal offenses “Trafficking in narcotics”, more than once, committed in collaboration in the form of a structured criminal group, “Structured criminal group” and “Committing criminal offenses by a criminal organization and a structured criminal group”, provided for by articles 283/a/2, 28/4, 333/a/1, 333/a/2 and 334/1 of the Criminal Code, and Pashk Syla,
accused of committing the criminal offense “Production and sale of narcotics” committed in collaboration, provided for by article 283/2 of the Criminal Code”.
2. The trial of this case was conducted under the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Erjon Çela, Erjon Bani and Gerd Hoxha, with decision No. 11, dated 03.02.2025, decided:
1. The guilty plea of the defendant Aleks Nanaj (alias Adil Nanaj) for committing the criminal offense of "Drug Trafficking", committed in collaboration in the special form of a structured criminal group, provided for by articles 283/a, paragraph 2, 28/4 and in conjunction with article 334/1 of the Criminal Code, his sentence to 16 (sixty-six) years of imprisonment.
2. The guilty plea of the defendant Aleks Nanaj (alias Adil Nanaj) for committing the criminal offense of "Structured criminal group", in the form of leading a structured criminal group, as provided for in Article 333/a, paragraph 1 of the Criminal Code, and based on this provision, his sentence to 3 (three) years of imprisonment.
3. In consolidating the sentences, pursuant to Article 55 of the Criminal Code, the conviction of the defendant Aleks Nanaj (alias Adil Nanaj) with a single final sentence of 16 (sixteen) years of imprisonment.
4. The defendant Aleks Nanaj (alias Adil Nanaj) should serve his sentence in a high-security prison.
5. Dismissal of the criminal case against the defendant Emiljant Lamkollari (alias Emiljan Lamkollari), accused of committing the criminal offenses of "Drug Trafficking", committed in collaboration in the special form of a structured criminal group, as provided for in Articles 283/a, paragraph 2 and 28/4 of the Criminal Code;
"Structured criminal group", in the form of participation, provided for by Article 333/a, paragraph 2 of the Criminal Code; as well as "Commitment of criminal offenses by a criminal organization and a structured criminal group" provided for by Article 334, point 1 of the Criminal Code, since in application of Articles 387/1 and 328/1/ë it results that the defendant is deceased.
6. Based on Article 389 of the Code of Criminal Procedure, the termination of the personal security measure "prison arrest", imposed on the defendant Emiljant Lamkollari (alias Emiljan Lamkollari), by decision no. 81, dated 06.05.2019, of the Court of First Instance for Serious Crimes, Tirana.
7. The guilty plea of the defendant Pashk Syla for committing the criminal offense of "Production and sale of narcotics", committed in collaboration, as provided for by Article 283, paragraph 2 of the Criminal Code, and based on this provision, his sentence to 7 (seven) years of imprisonment.
8. The defendant Pashk Syla will serve his sentence in a regular security prison.
9. The defense attorneys appointed by the court for the defendants in this trial, attorneys L.Xh and ST, shall be remunerated by the state according to the fees provided by law.
10. The procedural costs during the investigation phase as well as the court costs are jointly and severally borne by the defendants Aleks Nanaj (alias Adil Nanaj) and Pashk Syla.
11. This decision may be appealed by the parties within 15 (fifteen) days to the Special Court of Appeal for Corruption and Organized Crime, a deadline which begins on the day following the notification of the decision.
