The Supreme Court returned for retrial one of the events in the city of Elbasan, which would have been closed as a massacre, in case a citizen had not intervened, who quite by chance removed a package of over 1 kilogram of C4 from a vehicle.
The suspect who was sentenced by the courts to 25 years in prison is Astrit Sinanaj, accused by the prosecution of being the person who installed a significant amount of explosives in a vehicle, such that if it had exploded, experts in the file say, it would have caused the killing of all to the people who were in that perimeter.
The 48-year-old was identified from the surveillance of 13 security cameras in the city of Elbasan, after a quantity of 1022 grams of C4 was discovered in May 2017 in Fuat Verzivolli's vehicle.
The latter, during the trial, said that he had never clashed with the suspect, but that he was used as bait during the clash of gangs in Elbasan.
"I would go to watch the game at the food market and they wanted to harm them. The goal was not to harm me, but to use me as a post. Çapja sent it, I wasn't the target, I was the postman, since I was the only one going there to the market, meeting Sokol Sanxhaktari, Suel Çela and some others", the target confesses.
But the prosecution says that the report-expertise shows that the suspect made the phone call through which the explosion was remote-controlled, which did not happen, not because of him, but because a citizen had seen a package in the vehicle by chance and had driven it away earlier.
But Astrit Sinanaj insists that he was not heard by the courts because he too had requested expertise with the claim that the person appearing on the security cameras is not him and that the phone did not belong to him.
The Supreme Court considers that for an impartial trial, a group of experts should examine the security footage and compare it with the suspect's identity.
Simultaneously with the argument of an impartial trial and the possibility of equality to be heard both for the prosecution and for its accused, the Supreme Court directs the retrial against Astri Sinanaj from the appeal, in the light of a real judicial debate to influence the discovery of the truth and the delivery of justice
For seven years, the suspect has insisted on his innocence because, according to him, he had no motive to kill the businessman and that there was no evidence linking him to Çapaj, who are opponents of Suel Çela's group, who is still wanted by SPAK ./ TCH
