The arrest by the police of the brother of the deputy of the Socialist Party Eduard Ndreca, Armando Ndreca, suspected of being involved in the cultivation of narcotic plants in Kashnjet of Lezha, was considered illegal by the court, as it was done without convincing evidence.
Report Tv has secured the whitewashed decision of the Court of Lezha, with the arguments that brought Ndreca out of the cell. From the investigations of the prosecution, from the examination of the phone of the arrested Elis Shpellzaj, the English phone number +447426932098 was found registered under the name "Bellanoca" and this number, according to the information collected by the police, belongs to Armando Ndreca, but the decision states that it has not been possible to prove something like that.
According to the prosecutor's office, the investigation showed that Ndreca had phone calls with another arrested in flagrante delicto for cannabis, Armel Nikdukaj, on whose phone there was a call with Armando Ndreca, also from the information collected by the judicial police are created doubts that the deputy's brother was involved, but again it does not appear that concrete evidence has been presented, but despite this the court has assessed that we are at a very early stage of the preliminary investigations where there are enough clues or data that can create grounds for suspect that the detainee has committed the offense for which he is accused.
The court, in the justification of the decision, emphasizes the fact that initially the written request of the prosecutor Irena Sufaj was submitted to impose the measure of security "arrest in prison", but in the court session the prosecutor changed her position requesting "compulsion to appear".
Prosecutor Sufaj is known to have justified the change of position with the reason that from the investigations so far no evidence has been found to justify the imposition of a heavier security measure, as well as with the other justification that it was a short time and that is why they are not administered by the prosecution body some evidence, such as the transcripts of the interceptions carried out by the police for this proceeding.
In this aspect, according to the court's decision, it turns out that it was the prosecutor of the case herself, who changed her position in the session, assessing before the court that there is not enough evidence and the measure had to be changed.
Seeing the position of the prosecutor and the evidence presented by her, judge Edlira Çota assessed the detention of Armando Ndreca as illegal, as the conditions and criteria set forth by the law are not met, and set the measure "compulsion to appear" once every two weeks.
