Full decision
1. The Special Prosecutor's Office against Corruption and Organized Crime on 31.07.2023 submitted to the Court the request with the object: Sending for trial the criminal case in charge of the defendants Dhionisios Alfred Beleri and Pandeli Kokaveshi accused of the criminal offense "Active corruption in the election" carried out in cooperation provided by articles 328 - 25 of the Criminal Code.
2. The trial of this case took place with the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judges Erjon Çela, Irena Gjoka and Flora Hajredinaj, with decision No. 14, dated 05.03.2024 decided:
1. The guilty declaration of the defendant Pandeli Kokaveshi, for the commission of the criminal offense "Active corruption in elections" carried out in collaboration, provided for by articles 328 - 25 of the Criminal Code and based on these provisions, his punishment with 1 (one) year and 6 (six) months of imprisonment.
2. In application of Article 59 of the Penal Code, it is ordered to suspend the execution of the sentence of imprisonment, for the remaining part of it without serving, putting the defendant Pandeli Kokaveshi on probation for a period of 3 (three) years , provided that during this time he does not commit another criminal offense and maintains regular contact with the Office of the Probation Service where he resides.
3. Pursuant to Article 261/1 letter "b" of the Penal Code, the cancellation of the personal security measure "Obligation to appear in the Judicial Police" assigned to the defendant Pandeli Kokaveshi with decision No. 19, dt. 01.06.2023 of the Special Court of Appeal for Corruption and Organized Crime.
4. The guilty plea of the defendant Dhionisios Alfred Beleri, for the commission of the criminal offense "Active corruption in elections" carried out in collaboration, provided by articles 328 - 25 of the Criminal Code and based on these provisions, his punishment with 2 (two ) years of imprisonment.
5. The serving of the sentence for the defendant Dhionisios Alfred Beleri starts from the day of his arrest dt. 12.05.2023 and be carried out in an IEVP, ordinary security prison.
6. Në zbatim të nenit 190/1 gërmat “a” dhe “ç” të K.Pr.Penale, në lidhje me provat materiale të sekuestruara për llogari të këtij procedimit penal, Gjykata disponon si më poshtë :
– Një CD-R Maxell mbi të cilën është shënuar me shkrim dore “Komisariati Himarë Dt. 10.05.2023”, një DVD-R mbi të cilën është shënuar shkrim dore “Komisariati Himarë Dt.11.05.2023”, DVD+RË” EMTEC, mbi të cilën është shënuar me shkrim dore “Proc. Nr. 489 dt 08.09.10.11 i 5 – 2023 Himarë. Vlore, të qëndrojnë në dosje.
– 8 (tetë) karmtonedha të prerjes 5.000 lekë, të konfiskohen dhe kalojnë në favor të shtetit.
– Aparat celular i llojit “RedMi”, ngjyrë e zezë, i përdorur nga i pandehuri Pandeli Kokaveshi, të konfiskohet dhe kalojë në favor të shtetit.
– Aparat celular i llojit “Iphone” me ngjyrë të zezë, me mbrojtëse plastike me ngjyrë të zezë, i përdorur nga i pandehuri Dhionisios Alfred Beleri, të konfiskohet dhe kalojë në favor të shtetit.
– Pajisje DVR e markës “Dahua”, numër serie SN 6J001308PA213DF64, sekuestruar shtetases Ermira Stoli, ti kthehet kësaj shtetaseje.
– Aparat celular i llojit “Iphone 11 Pro Max”, ngjyrë e zezë, me veshje të jashtme plastike të kuqe, në gjendje të fikur, me IMEI: 352843111503600, i përdorur nga dëshmitari Arsen Rama, ti kthehet ketij shtetasi.
– Një qese plastike, ngjyra e bardhë, me mbishkrime me ngjyrë të gjelbër, brenda së cilës gjenden: – një faturë tatimore e subjektit me NIPT L06718204R, e datës 11.05.2023, një faturë tatimore me shkrim në gjuhën Greke, me vlerë 27,00 EUR, dy tollona nafte 10 litra dhe dy tollona nafte 5 litra të karburant “Kastrati”, dy blloqe të vegjël shënimesh me fletë me ngjitëse me ngjyrë përkatësisht rozë dhe jeshile. Një kartë e re celulari sim Vodafone, në paketim letre, me numër 0695378872, katër fletë letre me mbishkrime në gjuhën greke, të kapura së bashku, një kartë vizitë me shkrimin Laptop service, një portofol material lëkure brenda së cilit gjendet : një dokument me fotografi i plastifikuar, me shkrim në gjuhën Greke; një kartë debiti e bankës “Alpha Bank” me numër 5357 2900 0174 0104; një kartë debiti e bankës “NBG” me numër 5351 4200 2462 0605; një dokument me fotografi material plastik me mbishkrimin “Omonia” dhe me numër 14090090; dy karta plastike me mbishkrimin përkatësisht “Grand Casino” dhe “Regency Casino” si dhe tetë kartëvizita të tjera, sende këto të sekuestruara gjatë kontrollit të të pandehurit Pandeli Kokaveshi, t’i kthehen këtij të fundit.
7. Shpenzimet procedurale gjatë fazës së hetimit në shumen totale 166.920 (njëqind e gjashtëdhjetë e gjashtë mijë e nëntëqind e njëzet) lekë si dhe shpenzimet gjyqësore, sipas formularit përkatës, u ngarkohen të pandehurve, në mënyrë solidare.
8. Kundër këtij vendimi mund të bëhet ankim nga palët brenda 15 (pesëmbedhjetë) ditëve në Gjykatën e Posaçme të Apelit për Korrupsionin dhe Krimin e Organizuar, afat i cili fillon nga dita e nesërme e njoftimit të vendimit.
