The Court of Appeals has sentenced 52-year-old Agron Tufa, who is suspected of the murder and subsequent burial of Kejsi Hysa, an event that occurred 7 years ago, to 30 years in prison.
The panel of judges at the Court of Appeal, composed of judges Fatri Islamaj, Edlira Petri and Marsela Pepi, decided to uphold the decision given by the First Instance Court.
The convict will serve his sentence in a high-security prison.
Appeal Decision
Based on the material referred by the Krujë Police Commissariat, the Krujë Judicial District Prosecutor's Office has registered the criminal proceedings of 2018, which are related to the event that occurred on 07.07.2018, where the citizen with the initials S. H filed a report at the Laç Police Commissariat for the disappearance of his son with the initials KH.
After questioning the citizen with the initials H. R, the latter stated that he, together with citizen A. T, had killed and buried the citizen with the initials KH near the neighborhood cemetery.
At the request of the Prosecutor's Office, the trial of the criminal case against: was held at the Krujë Judicial District Court.
I. the defendant with the initials Agron Tufa (in absentia), accused of committing the criminal offenses of “Intentional murder”, committed in collaboration, “Unauthorized possession and production of weapons, explosive weapons and ammunition”, committed in collaboration and “Hiding or disposal of a corpse”, committed in collaboration, provided for by articles 76-25, 278/1-25 and 303-25 of the Criminal Code.
At the end of the trial, the Krujë Judicial District Court, with decision no. 99, dated 17.06.2021, decided:
• The guilty plea of the defendant AT for committing the criminal offense of “intentional murder” committed in collaboration provided for by article 76-25 of the Criminal Code and in application of this provision his sentence to 20 (twenty) years of imprisonment.
• The guilty plea of the defendant A. T for committing the criminal offense of “illegal possession and production of weapons, explosive weapons and ammunition” committed in collaboration provided for by article 278/1 -25 of the Criminal Code and in application of this provision his sentence to 5 (five) years of imprisonment.
• The guilty plea of the defendant A. T for committing the criminal offense of “hiding or destroying a corpse” committed in collaboration provided for by article 303-25 of the Criminal Code and in application of this provision his sentence to 5 (five) years of imprisonment.
• Pursuant to Article 55 of the Criminal Code, the sentences for the defendant A. T. are combined, with a single sentence of 30 (thirty) years imprisonment.
• The sentence for the defendant A. T. shall be served in a high-security prison.
On 06.01.2024, the Italian Authorities made it possible to arrest the defendant with the initials AT with the aim of his extradition from Rome to Albania; this extradition was carried out on 13.09.2024.
On the request with the subject: “Restoration of the deadline for appealing against decision no. 99, dated 17.06.2021 of the Krujë Judicial District Court” submitted by the legal representative of the convicted person with the initials AT, the Court of First Instance of General Jurisdiction of Tirana, with decision no. 1244, dated 10.12.2024, has decided:
“Reinstatement of the convicted person AT within the deadline to file an appeal with the Court of Appeal of General Jurisdiction, against decision no. 99, dated 17.06.2021 of the Krujë Judicial District Court…”
The appeal case was reviewed on the basis of the appeal filed by the defendant with the initials A. T, who requested the annulment of the decision and the return of the case for retrial to the Court of First Instance of General Jurisdiction of Tirana, with another trial panel.
At the end of the trial, today on 25.02.2025, the Court of Appeal of General Jurisdiction, composed of the panel with Judge Rapporteur Mr. Fatri Islamaj and members Ms. Edlira Petri and Ms. Marsela Pepi, decided:
-Enforcement of decision no. 99, dated 17.06.2021 of the Krujë Judicial District Court.
