Trouble is back for Olta Xhaçka and Artan Gaçi. No matter how much Rama defends them, it seems their end is certain.
The Special Court today ordered SPAK to urgently register criminal proceedings and take Olta Xhaçka and her strategic investor husband, Artan Gaçi, under investigation.
The order comes after an appeal by Fredi Beleri, who appealed to the court SPAK's decision not to investigate the pair in question. They were previously indicted by Beleri for property abuses in the south, but after the investigation SPAK amnestied them.
However, the decision signed by Judge Flora Hajredinaj states that SPAK should register a criminal complaint against Olta Xhaçka and her husband, Artan Gaçi, on charges of abuse of office, falsification of documents, and laundering the proceeds of a criminal offense committed in collaboration.
" In the specific case, the Special Prosecution Office should register criminal proceedings and continue the investigations, on the allegations in the complaint registered with no. 81/2023 that the former Mayor of Himara, Jorgo Goro, the Vlora District Council and former employees of the Vlora ZVRPP, in cooperation with each other, have committed acts related to the falsification of official documents, which were used to register an immovable property owned by the entity Foto Mëhilli, and this property was alienated in favor of third parties, specifically the family members of the complainant Olta Xhaçka, who at the time of these decisions by the Council of Ministers, exercised the state duty of Minister of Defense at that time, and the political function of MP.
"Citizen Olta Xhaçka, through her inactions, by not declaring the conflict of interest, has benefited through the marital regime, property rights and illegal benefits, which according to the law on strategic investors and the law on conflict of interest, do not belong to her. This citizen, through strategic investment in a falsified property, has benefited from the right to free use of state assets for which ordinary citizens pay tax obligations, etc. ," the decision states.
Previously, SPAK prosecutor Olsi Dado had favored Olta Xhaçka and Artan Gaçi by not holding them criminally responsible. SPAK sent only the former mayor of Himara, Jorgo Goro, for trial. But it seems that now the file must be reopened.
