
Analyst Enton Abilekaj considered the Constitutional Court's decision to be fair, which overturned the dismissal of Erion Veliaj as Mayor of Tirana, but also the decree to hold partial elections in the capital.
Invited to the show "The Unexposed", Abilekaj said that beyond the names, the decision is an important precedent, to protect local government from the "invasion" of the government, as happened today with the Municipality of Tirana.
"The Constitutional Court does not discuss the issue of corruption on the merits. In the case of Veliaj, there is a discussion, which prevails, Article 62 of the law on local government or Article 115 of the Constitution? Article 62 of the law does not exist if it does not refer to the Constitution. We were discussing today, that with this legal basis that we have, could the central government intervene over local government?
I want Veliaj, if dismissed and convicted, to happen as a victory of justice, not as a violation of the law. If we have this battle, with orders given in the SP Assembly, by the SP chairman, and then executed… The central government has occupied the Municipality of Tirana, it imposes itself on every decision. This creates a precedent in favor of the autonomy of local government. This is based on the Constitution.
I think it was a fair decision, who does it serve? Rama? Rama serves the opposite.
If Veliaj goes to court and says, now that the case is in trial and the prosecution's investigation is over, the prosecution no longer has the right to keep me in custody and demands reinstatement? Then he can return. Is this a victory or a loss for Rama?
"So we can't see things in terms of who won and who lost," Abilekaj said, among other things.
