
The former mayor's appeal to the Constitutional Court blocks the decreeing of early elections; the President is expected to request interpretation, while the decision becomes vital for Veliaj's freedom and Rama's electoral plan.
Sending Erion Veliaj's letter to the Constitutional Court not only suspends his dismissal, but also jeopardizes early elections in Tirana.
The government has sent President Bajram Begaj the letter regarding the vacancies of mayors of 6 municipalities, where the head of state must decree elections within 48 hours.
The letter signed by Engjëll Agaçi seems like a mystery in itself and raises several questions. This is because the government made the decision to dismiss Veliaj last week. It was possible that immediately after the dismissal, the Prime Minister's Office would have sent the letter to the Presidency, and the head of state would have had to respond quickly, consulting with the Constitutional Court, which had not yet filed a complaint.
But, strangely, the Prime Minister's letter seems to have waited for Veliaj's lawyers to move to take the complaint to the Constitutional Court, and was even sent 24 hours later.
This delay opens two dilemmas: either the Prime Minister was afraid to act hastily, for fear that it might later back down, or there was a remote coordination with Erion Veliaj.
In fact, Veliaj is not interested in opening a frontal fight with Edi Rama today, as he is in a disadvantageous position. However, the appeal to the Constitutional Court is necessary for his legal status.
Veliaj's international lawyers have the file ready to send to the Strasbourg Court, but for this to happen, they must exhaust all levels of trial in Albania, where the Constitutional Court is final.
With the decision that the Constitutional Court will announce on the dismissal, Veliaj's international defenders will have the "green light" to submit the request to the European Court of Human Rights.
The lawsuit in Strasbourg does not deal with the basic accusations of SPAK against the former mayor, but with the possible violations of the constitutional and legal rights of an elected official. From the arrest, to the treatment by SPAK, to the dismissal by the government, Veliaj has a good chance of receiving a positive decision from Strasbourg. If the court finds that his rights have been violated, he can gain freedom and pursue the case from home.
Veliaj has no interest in clashing with Rama now, because this would strengthen the prime minister, weaken the opposition and would not bring him any political benefit.
On the other hand, Rama, if new elections are not announced in Tirana, the whole scheme for the other municipalities collapses, since the capital is the "big piece of steak".
The Prime Minister's letter has put pressure on the President, who will most likely suspend the decree of extraordinary elections until he receives a preliminary decision from the Constitutional Court.
Begaj is expected to ask the Constitutional Court for an interpretation of whether the position of mayor is vacant or not. The Constitutional Court could issue a preliminary decision stating that the position is considered vacant, while reviewing the legality of Veliaj's dismissal on its own. Such a decision would serve as a precedent for similar cases in the future.
This pause, from the President's request for interpretation to the decree, could last at least two weeks. Without Tirana, the announcement of elections is impossible, unless the Constitutional Court says otherwise. So, we are in a "win-win" scheme, where:
1. Veliaj gains time and the Constitutional Court's decision on Strasbourg,
2. Rama wins the elections to confirm support, and 3. Berisha gains time to enter into negotiations with the prime minister, using the oligarchs as intermediaries./ Pamphlet
