The deputy of the Socialist Party, Petro Koçi, has filed a draft law in the Assembly, against those he calls "traitors of the nation".
Through it, he demands that the candidacy, election or appointment to public offices of persons who have been convicted of violence or desecration of national symbols be prohibited.
Petro Koçi said to "Abc News" that the proposed draft law was given the impetus by Fredi Beleri, who appeared in public with the flag of Vorio Epiri, an act that contradicts and humiliates the Albanian national symbols.
He emphasized that if he personally did not know about the flag of Vorio Epiri in his meetings with the citizens, then Fredi Beleri should come out and publicly distance himself from this case.
While the representative of PD Skerdjan Dhuli, stated that the meeting where the flag of Vorio Epiri was displayed was not organized by his electoral headquarters, but that symbol was placed by the residents of Samos.
Excerpts from the studio debate:
Dhuli: I did the Beler campaign, for which if I were to come back I would do it 5 times, being convinced of victory, sometimes we neglected.
Sokol Balla: He campaigned with the flag of Vorio Epiri, which is not accepted by Greece. Vorio Epiri means that the Albanian state does not exist.
Dhuli: Regarding the photo of Beler, the meeting happened during the 2023 campaign in Samos, it was not organized by us as the electoral headquarters, but by the residents, Beler was alone. It is not a justifiable explanation, but Beleri was alone, the flag was placed by the residents, we as the electoral staff are detail-oriented. On the main banner they had our logo, the meeting in question did not take place in Albania, but Samos in Greece. In principle, I agree with this legal initiative. But there is a problem, the problem in this case is not mine as a lawyer, but the Venice commission.
If one of his initiatives was approved, it would contradict the foundation of the Council of Europe. Albania is a member of the Council of Europe, and we must accept that criminal justice holds the principle of rehabilitation as sacred. If we accept such an initiative, we punish a person eternally. And secondly, the law does not have retroactive force, which means that if it is approved in May 2024, it cannot be taken as a reference for criminal offenses that happened many years ago. If it happens, an aspirant state for the EU will never accept it, and I don't think it should be so easy to pass. I repeat, in principle I am in favor, let this change be approved tomorrow, but it is accompanied by problems.
Petro Koçi: I got the impetus for the initiative from the Beleri case. Coming to the flag of VorioEpir, we can take it for granted that the flag was put up by the residents, but the candidate for mayor should make a statement clearly distancing himself from this moment, which has not happened. I took the cue from the Beleri case in the sense that the public was very concerned about the fact that the institutions could not prevent the candidate Beleri from running even though he was convicted, according to the media, for insulting the symbols of the Republic, or in the event of To Peskepi.
This gave me a trigger to take up that initiative. Today we have a law, we are not able to discuss the constitutionality, it is in force. In the way it is formulated, I think that the absence of these two articles of the criminal code is a bit compromising. Because you prohibit someone from being elected or appointed to a public office when he has committed a crime of another nature, but not a person who has desecrated national symbols. It cannot be rehabilitated, it cannot be changed.
