Shkruar nga PamfletiPrime Minister Edi Rama and the Minister of Culture and Tourism, Blendi Gonxhe, have been indicted for the criminal offenses of "abuse of office" and "violation of equality of participants in public tenders or auctions", in collaboration, in connection with the 4.2 million euro financing of Kanye West's concert.
The Democratic Party Parliamentary Group has reported Prime Minister Edi Rama and Minister Blendi Gonxhe to SPAK, accusing them of the criminal offenses of "abuse of office" and "violation of equality of participants in public tenders or auctions", in collaboration.
According to the DP's announcement, the complaint is related to the 4.2 million euro financing of the American artist Kanye West's event.
The Democrats have announced that, along with the complaint, they have also filed with SPAK the arguments and documentation that, according to them, support the accusations.
The criminal complaint filed by the DP parliamentary group states that "the legal framework in force has sanctioned the obligation of state authorities, in the exercise of their powers and responsibilities, to use state financial resources efficiently and effectively, respecting the principles of sustainability of public finances, equality before the law and free competition. In this regard, the Constitution, the Stabilization and Association Agreement, as well as the laws issued in their implementation, have sanctioned the prohibition of any behavior or action of state institutions, which in themselves violate the State Budget, freedom of participation and equality of parties in the provision of goods and services, regardless of whether they are used for public purposes or not. It results that on the basis of a private economic operator, citizen Blendi Gonxhja, acting Minister of Tourism, Culture and Sports, has initiated the procedure for the approval of the normative act, in order to allocate a fund of 4.2 million Euros to this operator, using the reserve fund of the State Budget. The latter, referring to the above legal provisions, can only be used for expenses that are not known and are impossible to predict, such as cases of natural disasters, floods, earthquakes, epidemics and civil emergencies. In the specific case, we are not faced with any of these cases, since the musical concert was a planned event in time, and the private economic operator had the opportunity to apply in advance to benefit from a certain fund for the realization of this activity, in accordance with legal procedures. By doing so, citizens Edi Rama and Blendi Gonxhja on the one hand have violated the reserve fund, which constitutes one of the main groups of expenses of the State Budget, as well as have violated the principles of free competition and non-discrimination, since such an opportunity was not foreseen for other economic operators, who could also apply to benefit from financial support for the realization of this concert or similar ones.
The opposition has previously opposed this funding, calling it a use of government reserve funds for a private activity.
“From the above, it is clear that citizen Edi Rama, acting Prime Minister of Albania, and citizen Blendi Gonxhja, acting Minister of Tourism, Culture and Sports, in collaboration with each other, have acted contrary to the law regarding the use of the reserve fund to support a private musical activity, harming the legitimate interests of the state, and in this sense their actions fulfill the element of the objective side of the criminal offense of “Abuse of office”, provided for by Article 248 of the Criminal Code. On the other hand, both of these citizens, in collaboration with each other, have violated the rules regarding the freedom of participation and the realization of equality of citizens in public tenders, with the aim of creating unfair advantages and privileges for a certain economic operator, thus fulfilling the element of the objective side of the criminal offense of “Violation of equality of participants in public tenders or auctions”, provided for by Article 258 of the Criminal Code.” , it is stated in the report filed with SPAK.
