The Democratic Party has warned that the changes to the Criminal Code will be overturned in the Constitutional Court.
On the QUO VADIS show on Vizion Plus, DP MP Oerd Bylykbashi stated that there is a clear precedent from the Constitutional Court that, according to him, makes this article untenable.
According to Bylykbashi, the mandate of someone elected by the people cannot be equated with that of an appointed official.
The Democratic MP described the initiative as a personal effort by the Prime Minister.
" I am presenting to you the unconstitutionality of this article. We can continue to spin this story, but all that I said cannot be overlooked, because today there is a decision of the Constitutional Court. The Constitutional Court cannot 'eat shame with bread'. There is a precedent, which is decision no. 212 of 2002. That decision determines this issue, as there are several other decisions of the Constitutional Court that revolve around the same topic. So what happens? You cannot simply 'attach' elected persons of the electoral subject. No, they have a mandate from the people through votes, this is democratic representation.
While these others have the mandate from the Constitution and the law, they are appointed, starting from the Prime Minister and so on, and they do not have the same mandate nor the same protection. So, putting both of them together there, as if we had forgotten this along the way, is unjustifiable, we could not have forgotten this for 30 years. So, this is clearly an attempt by Edi Rama to put a name to an article for his own sake. This is unconstitutional, it is an unacceptable policy and no one will accept it , "said Bylykbashi.
