We, the petitioners, in the capacity of 1/5 of the deputies of the Assembly of the Republic of Albania, are presenting the following facts, evidence and legal arguments, as to why we have submitted this request, which basically aims to resolve the conflict and competences between the institution of The Assembly on the one hand and the judicial power on the other hand, in terms of removing and/or restricting the freedom of a Member of Parliament, in all forms, when these restrictions of freedom are carried out by the judicial power without asking, requesting and obtaining authorization in advance expressed by the Assembly.
Based on what we will argue below, we the petitioners also ask the Constitutional Court for the final interpretation of Article 73, point 2, of the Constitution of the Republic of Albania, so that similar conflicts do not repeat in the future . others in the lawsuit against the Reestablishment deputies.
