Former head of the Central Election Commission, Kristaq Kume, has spoken about the vacancy that is expected to be created in the Assembly following Prime Minister Edi Rama's proposal for Ogerta Manastirliu to run for mayor of Tirana.
Kume stated that the vacant mandate in the ranks of the Socialist Party belongs to Xhemal Qefalia, contradicting rumors that Blerina Gjylameti is a possible replacement.
"Ogerta Manastirliu's place in the Assembly will be taken by Xhemal Qefalia according to the distribution of votes in the Tirana district on May 11 ," said Kume in the New24 studio.
He explained that the discussion taking place about gender representation in this case stems from a misunderstanding of the way the Electoral Code addresses this issue. He stated that the Code does not talk about “women” or “men”, but about the less represented gender and in this case, according to him, gender balance is not violated.
"The SP has won 19 mandates in Tirana: 10 are held by women and 9 by men. With the departure of one woman, there is a tie. At this moment, the Code does not speak about gender ."
According to Kumes, the ranking of candidates based on preferential votes is what determines who receives the mandate.
He also emphasized that, although the beginning of the Electoral Code emphasizes the need for gender representation in the Assembly (at least 1/3 of the deputies to be from the less represented gender), this does not automatically mean that every replacement must mechanically maintain the same gender ratio.
"Ko di Zjedhor requires that the Assembly have at least 40 deputies from the less represented gender, but this does not exclude division according to the result of preferential votes. "
In conclusion, Kume stated that any debate on this issue should be based on the correct interpretation of the electoral law, and not on biased perceptions of gender equality, which in this case do not change the legal ranking of candidates.
