
The son-in-law of former Prime Minister Sali Berisha, Jamarbër Malltezi, reacted after the Supreme Court did not give any decision on the case and the stamp of the DP, but sent the case to Appeal.
Through a post on Facebook, Malltezi states that in Albania there are over 70 political parties that are in opposition, except for the Socialist Party.
"There are over 70 political parties in Albania, all of them (except SP) are in opposition on paper. In reality, we all know who is in opposition and who has been bought either by Rama or Soros, who is facing and who is hiding, who is a hostage and who is free and unblackmailable", writes Malltezi in his reaction.
Today, the Civil College of the Supreme Court has returned the case for the seal and logo of the Democratic Party to the Court of Appeal for reconsideration.
In the decision made today, the High Court overturned the decision of the Court of Appeal of the General Jurisdiction of Tirana, with the argument that "it allowed procedural violations that make the decision given by it vulnerable".
The Civil College of the Supreme Court argues that the conflict between the parties as to who owns the seal and logo of the Democratic Party is a matter to be resolved by this court itself.
"The Board finds that the Court of Appeal of the General Jurisdiction of Tirana has not given answers to the requests of the parties in the respective appeals, while it has mainly considered issues for which the parties have not raised as claims in the appeal, and which in any case did not are grounds for overturning the decision and sending the case for reconsideration. The College assesses that the claims raised in the appeals presented to the Court of Appeal of the General Jurisdiction of Tirana are issues that could be resolved by that court itself", says the decision of the Civil College of the Supreme Court.
For this reason, this court has decided that this case be returned for reconsideration in the Appeal with another panel of judges.
