The decision of the Appeal in The Hague for the former commander of the KLA, Salih Mustafa, is given today.
The latter was sentenced to 26 years in prison for war crimes. This was made known through a decision issued by the Court of Appeal headed by Michele Picard, on November 27, 2023, to set the date of the announcement of the decision on the court case against Mustafa.
It says that the decision in this court case will be held in a public session, starting at 9:30. The Pre-Trial Judge confirmed the Indictment against Salih Mustafa on June 12, 2020. Mustafa was arrested and transferred to the Kosovo Specialized Chambers Detention Unit on September 24, 2020.
On May 7, 2021, the Pre-Trial Judge transferred the case file to Trial Panel I. The trial began on September 15, 2021. On February 4, 2022, the Office of the Specialized Prosecutor closed the presentation of its evidence. The Victim Advocate presented her evidence on March 21. On May 26, 2022, the Defense closed its presentation of evidence. Closing statements were made in the period 13-15 September 2022. The verdict was announced on 16 December 2022. The Trial Panel found the accused guilty of the war crimes of arbitrary detention, torture and unlawful killing and sentenced him to 26 years in prison. The Trial Panel found Mustafa not guilty of the crime of cruel treatment.
The pronouncement of the order to compensate the victims was made on April 6, 2023. The Court ordered Mustafa to pay a total amount of 207,000 euros as compensation for the damage caused to the victims of the crimes. On February 2, 2023, the Defense filed a notice of appeal against the Judgment. Next, the president appointed the Panel of the Court of Appeal composed of judges Michele Picard, Kai Ambos and Nina Jorgensen. The appeal hearing was held on October 26 and 27, 2023.
