The defense of former Kosovo President Hashim Thaçi has responded to the Specialized Prosecutor's Office (SPO), opposing the assessment that detention remains a necessary and proportionate measure in his case.
In the submission to the Kosovo Specialist Chambers, the lawyers argue that the Prosecution's claims that Thaçi may have access to significant funds and support to flee are unfounded.
" The SPO's reliance on the claim that Mr. Thaçi can access substantial funds and easily secure support is speculative. Mr. Thaçi is in detention, is unemployed, and has withdrawn from political life since late 2020; consequently, any support he may have had has necessarily diminished over time and due to the significant expenses incurred by the two court cases he is currently facing ," the defense response states.
Regarding the claim that Thaçi may flee to countries not under the jurisdiction of the Specialist Chambers, the defense considers that the measures proposed by it are sufficient to eliminate any risk of flight.
" Mr. Thaçi's proposed surrender of his passports – a measure that has also been imposed on his co-defendants – is sufficient to mitigate any such risk ," the lawyers argue.
The response also mentions the financial guarantee of 50 thousand euros, proposed by Hashim Thaçi, as another element that, according to the defense, guarantees compliance with any measure that the court may impose.
" Last but not least, the substantial financial guarantee proposed by Mr. Thaçi further limits any risk of flight, emphasizing that his guarantors are his brother and close friends ," the letter states.
Based on these arguments, the defense requests that the Specialist Chambers reconsider the security measure and accept Hashim Thaçi's release under conditions that the court deems appropriate.
