The decision comes after a prolonged political stalemate that has left Kosovo without new institutions since the parliamentary elections of February 9, 2025.
The Constitutional Court of Kosovo has declared that the deputies of the Assembly of Kosovo must conclude the constitutive session of the new parliamentary composition no later than 30 days, by electing the Speaker and five Deputy Speakers of the Assembly. The decision comes after a prolonged political stalemate that has left Kosovo without new institutions since the parliamentary elections of February 9, 2025.
"1. The session of the constitution of the Assembly of the Republic of Kosovo, which began on 15 April 2025, has not been concluded and as a result of the failure to elect the President and Vice-Presidents of the Assembly of the Republic of Kosovo, it has not been conducted in accordance with the provisions and requirements of paragraph 1 of Article 66 [Election and Mandate] of the Constitution of the Republic of Kosovo; and
2. The elected Members of the Assembly of the Republic of Kosovo, pursuant to paragraph 1 of Article 66 [Election and Mandate] in conjunction with Article 67 [Election of the President and Vice-Presidents], Article 70 [Mandate of Members] and Article 74 [Exercise of Function] of the Constitution of the Republic of Kosovo, Chapter IV of the Rules of Procedure of the Assembly of the Republic of Kosovo and in accordance with this Judgment, shall, as soon as possible and no later than thirty (30) days, conclude the constitutive session of the Assembly by electing the President and its Vice-Presidents," the Constitutional Court's announcement states.
The constitutive session, which began on April 15, has so far marked 37 consecutive failures to elect the speaker and deputy speakers of the Assembly. The process has stalled due to disagreements between political parties over the candidacy proposed by the Vetëvendosje Movement (LVV), Albulena Haxhiu, for the post of speaker of the Assembly. Opposition parties, including the Democratic Party of Kosovo (PDK), the Democratic League of Kosovo (LDK), the Alliance for the Future of Kosovo (AAK) and the Serbian List, consider Haxhiu a divisive figure and have refused to propose members for the commission that would oversee the secret ballot for the speaker, thus blocking the process.
This issue has been further complicated by the debate over the constitutionality of the transition from open voting to secret ballot, which is currently being reviewed by the Constitutional Court following a request submitted on May 12, 2025 by AAK MP Time Kadrijaj, supported by 11 other opposition MPs.
Legal experts, such as former Deputy President of the Constitutional Court, Kadri Kryeziu, and Professor of Constitutional Law, Mazllum Baraliu, have criticized political parties for abusing legal loopholes in the Constitution, which does not set a clear deadline for the constitution of the Assembly. According to them, the lack of political compromise and the insistence of the LVV to retain Haxhiu as a candidate has deepened the institutional crisis, damaging the credibility of the institutions and Kosovo’s progress towards the Euro-Atlantic agenda.
President Vjosa Osmani has called for dialogue between parties to resolve the impasse, but so far her efforts have yielded no results. Meanwhile, some politicians have mentioned the possibility of new parliamentary elections alongside local elections in October, but this is seen as an ineffective solution by some experts.
The Constitutional Court has emphasized that it is reviewing the matter as a priority, and its decision is expected to provide clarity on the procedures and deadlines for the constitution of the Assembly, in the hope of unblocking the political crisis that has paralyzed Kosovo's institutions for almost five months.
