
The persons arrested for the terrorist attack on the Kosovo Police on Sunday in Banjska of Zveçan can be sentenced from 25 years to life imprisonment, says Gëzim Shala from the Kosovo Institute for Justice.
According to him, they will be tried in Kosovo for the serious crime of terrorism, as it is impossible for them to be extradited to Serbia due to the lack of an agreement on international legal cooperation. Likewise, Shala says that he does not expect Serbia to hand over to Kosovo the criminals who escaped in the north, despite yesterday's calls by the Minister of Internal Affairs, Xelal Sveçla.
Shala said that based on the Criminal Code of Kosovo, the crime of terrorism is among the most punishable and serious crimes in Kosovo.
"In this particular case, we are dealing with criminal acts of terrorism. Criminal offenses of terrorism are among the most punishable and serious offenses provided for in the Criminal Code of the Republic of Kosovo. If we really define what we mean by terrorism, it refers to the execution of actions defined by law of corrupt criminal acts which aim to destabilize the country, create fear in the general population and others. If we look at the punishments defined by the Criminal Code, then initially the lowest punishments are up to 25 years. However, in certain situations, if a terrorist attack ends with the death of a person, then the penalties are up to life imprisonment. Let's not forget the fact that in order to prevent terrorism, according to the Penal Code, a number of other offenses have been defined that incriminate various actions in order to prevent terrorism. Such as the preparation of criminal offenses of terrorism, assistance after the commission of criminal offenses and others".he expressed.
According to him, all persons who have committed the crime of terrorism and are caught on the territory of the country should be tried in Kosovo, regardless of their nationality.
"The criminal offense was committed in the Republic of Kosovo and in terms of the definitions of the place where the crime was committed and the issue of jurisdiction, in this particular case we do not even have an agreement on legal-international cooperation with Serbia. This means that the persons who committed this criminal offense and are caught in the Republic of Kosovo should be tried in Kosovo regardless of their nationality. In this particular case, the good that is being protected belongs to the Republic of Kosovo and the crime was committed in the territory of Kosovo", adds Shala.
He finds it difficult that even the fugitives in Serbia, some of them who are being treated in the regional hospital in Novi Pazar, will be extradited to Kosovo if they are arrested by the Serbian authorities.
"With Serbia, we don't even have an agreement on international legal cooperation. In the absence of this agreement, reciprocity is applied in some cases, which also does not exist in the present case. Now it seems that in this situation, based on these two aspects and the way Serbia has acted in the past, we have no possibility to extradite them. It remains to be seen how Serbia will deal with those persons with its system and its institutions of the justice system. But in this situation, what are we, Kosovo cannot extradite the persons who have already left Kosovo, except if they are caught in another state that has an agreement", he emphasizes.
The Basic Court in Prishtina has assigned one month of detention to two suspects for the attack on the Kosovo Police in the village of Banjské in Zveçan. In the early hours of the morning on Sunday, the sergeant of the Kosovo Police, Afrim Bunjaku, was killed, while other policemen were injured. The serious event took place in the village of Banjska in Zveçan, where Serbian terrorists attacked the police patrol, and then took refuge in the Monastery of Banjska.
