The Court of Arbitration for Sport (CAS) has decided in favor of the Albanian Football Federation (AFF), overturning the decisions made during the Extraordinary Assembly of the National Olympic Committee of Albania (KOKSH) held on January 10, 2021.
It is also claimed that all KOKSH assemblies held after January 10, 2021, including the election of the current President and Executive Committee are absolutely void.
Key Decision Points:
1. Decisions of the Assembly of KOKSH are declared invalid: CAS has declared invalid the decisions taken in the Extraordinary Assembly of KOKSH which had approved the new statute. This includes changes to the KOKSH statute, the dismissal of the President and the election of new members of the verification commission.
2. Procedural Irregularity: CAS found that KOKSH did not properly notify the ALF about the assembly and allowed the participation and voting of persons who were not members. These actions violated the established procedures and the rights of the ALF as a member federation.
3. Protection of ALF rights: By overturning the decisions of the assembly, the CAS has put in place the rights of the ALF to participate in and be regularly notified of KOKSH assemblies, ensuring representation and decision-making of right.
4. Financial Reimbursement: KOKSH has been ordered to pay CHF 4,000 for the AFL's legal costs and to cover 90% of the arbitration costs, reflecting the seriousness of the procedural violations.
The AFL is satisfied with the decision of the Court of Arbitration for Sport, which corrects the fundamental problems of the KOKSH membership. This decision is an important step towards preserving the integrity and justice in the governance of sports in Albania, as well as emphasizing the fact that, as a result, all KOKSH assemblies held after January 10, 2021, including the election of the President and the Executive Committee are absolutely invalid.
