The Tirana Prosecution Office has issued security measures for five Tirana Municipality officials and three business representatives, involved in a suspected forgery and abuse of office scheme, related to the demolition of six buildings in January 2021.
In total, the Tirana Prosecution Office has issued three "house arrest" measures and five "compulsory appearance" measures for the persons involved in the investigation.
The investigation began after a citizen complained that his building had been demolished by IMT without notice and without an official decision. During the verifications, the Prosecution and the Economic Crime Section discovered that some official documents used in the demolition procedures had been falsified, while fictitious works had been declared for some objects, causing financial damage to the budget of the Municipality of Tirana.
According to the investigation, in March 2021 the City Council approved a fund for the demolition of 15 buildings, including previously demolished buildings, allowing the winning company to declare false works. IMT employees have admitted that they did not conduct on-site verifications and relied only on internal documents.
The prosecution has also identified responsibility among the leaders of the Civil Emergencies Directorate, who are suspected of having signed false acts and minutes, committing the aggravated form of document falsification, as they had an official duty to issue them.

Prokuroria pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm, Tiranë lëshoi masa sigurie për pesë zyrtarë të Bashkisë Tiranë dhe tre përfaqësues të subjekteve, për vepat penale “Falsifikimi i dokumenteve” kryer në bashkëpunim më shumë se një herë dhe ‘Shpërdorimi i detyrës’, parashikuar nga nenet 186/2 dhe 248 të Kodit Penal.
Nga hetimet mbi procedimin penal nr.2505 të vitit 2021, nisur nga denoncimi i shtetasit A.Xh për prishjen nga IMT të pallatit të tij, pa njoftim e pa vendim zyrtar, Prokuroria pranë Gjykatës së Shkallës së Parë të Juridiksionit të Përgjithshëm, Tiranë në bashkëpunim me Seksionin e Krimit Ekonomik në Drejtorinë e Policisë Tiranë, provoi se në Janar 2021 janë shembur 6 objekte nga Bashkia Tiranë, duke përfshirë edhe pallatin nr.140 që ishte objekti i hetimit.
Ndërsa në mars 2021, nga ana e Këshillit Bashkiak u miratua fondi për “Demolimin dhe evadimin e mbetjeve ndërtimore” për 15 pallate duke përfshirë dhe objektet e demoluara më parë që në muajin janar nga Bashkia Tiranë.
Shtetasja A.M. si përfaqësuese e subjektit “Arb&Trans-2010″sh.p.k & “KLAJGER KONSTRUKSION” sh.p.k dhe mbikqyrës i punimeve subjekti “MAGING studio” shpk, që fitoi tenderin e demolimit të objekteve, ka përfshirë edhe objektet që ishin të demoluara që në muajin Janar 2021, duke paraqitur rrethana të rreme, punime fiktive dhe shkaktuar dëm në vlerë monetare buxhetit të Bashkisë Tiranë me disbursimin e fondeve publike për punime fiktive.
Dokumenti u hartua nga shtetasi Sh.M. në cilësinë e sipërmarrësit të punimeve, i cili ka konsumuar elementet e veprës penale të parashikuar në nenin 186/2 të Kodit Penal pasi ka qenë personi përgjegjës në hartimin e dokumenteve dhe ka paraqitur të dhëna të rreme.
Nga shqyrtimi i plotë i materialit hetimor, rezultoi se shtetasit S.Q. dhe R.R., në cilësinë e punonjësve të IMT-së pranë Bashkisë Tiranë, kanë hartuar preventivët e punimeve.
Ata kanë vepruar në kundërshtim me detyrën dhe rregullat profesionale dhe vetë e deklarojnë se nuk kanë dalë asnjëherë në terren për të verifikuar gjendjen reale të objekteve, se preventivat i kanë hartuar duke u bazuar vetëm në “projektin ekzistues” të përcjellë nga Drejtoria e Emergjencave Civile dhe se nuk mbajnë mend nëse konkretisht pallati nr.140 ka qenë ose jo në listë.
Ndërkohë u provua gjithashtu se shtetasi F.F. në cilësinë e administratorit përfaqësues të “Arb&Trans-2010″sh.p.k & “KLAJGER KONSTRUKSION”sh.p.k., ka konsumuar elementet e veprës penale të “Falsifikimit të dokumentave” parashikuar nga neni 186/1 i K.Penal, konkretisht me dokumentin “Procesverbal, mbi fillimin e punimeve në objektin “Demolimi dhe evadimi i mbetjeve ndërtimore per 15 pallate, mes tyre dhe pallatit nr 140 me vendndodhje në rrugën “Haki Stermilli”, njësia administrative nr.6 Tiranë.
Referring to the graphic expertise act, it is also proven that citizens A.Ç., General Director of Civil Emergencies, AB, Director of the Civil Emergencies Directorate, EG, Head of the Natural Disaster Compensation Policies Sector, have consumed the elements of the criminal offense of "Forgery of documents" and "Abuse of office".
Their role was directly related to the drafting, signing and use of official documents related to the "Construction Site Handover Act" and the subsequent documentation of the works for building no. 140 and the other buildings subject to the contract.
All three had a legal obligation to sign documents related to the demolition and waste disposal procedures. For this reason, any issuance of a false document by them constitutes not simply forgery, but an aggravated form of the offense under the third paragraph of Article 186, because the forgery is committed by the person who is precisely responsible for issuing the act in question.
As above, the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana requested the imposition of security measures against the persons under investigation:
"House arrest" for citizen A.Ç., General Director of Civil Emergencies, for committing the criminal offenses of "Abuse of office" and "Forgery of documents" committed in collaboration with more than one person;
"House arrest" for citizen AB, Director of the Civil Emergencies Directorate, for committing the criminal offenses "Abuse of office" and "Forgery of documents" committed in collaboration more than once;
"Compulsory appearance" for citizen EG, Head of the Natural Disaster Compensation Policies Sector of the Civil Emergencies Directorate for committing the criminal offense of "Forgery of documents" committed in collaboration with more than one person;
"Compulsory appearance" for citizen RR, IMT Specialist, for committing the criminal offense of "Abuse of duty";
“House arrest” for citizen SQ, Specialist of the IMT, Tirana Municipality, for committing the criminal offense of “Abuse of office”;
"Obligation to appear" for citizen AM, works supervisor, representative of BOE "Maging shpk & Imes-D shpk" for committing the criminal offense "Forgery of documents" committed in collaboration more than once;
'Obligation to appear' for citizen Sh.M., legal representative of BOE “Arb & Trans-2000” shpk and “KLAJGER Konstruksion” shpk and Administrator of the Entity “Arb & Trans -2000” shpk, for committing the criminal offense “Forgery of documents” committed in collaboration more than once; and
'Obligation to appear' for citizen FF, legal representative of BOE “Arb & Trans -2000” shpk and “KLAJGER Konstruksion” shpk for committing the criminal offense of “Forgery of documents” committed in collaboration with more than one person.
