The review of the criminal case against Arbë Paplekaj has started in the Court of Appeal of General Jurisdiction.
The session also takes place for six police officers of the Shqiponja department under accusation of abuse of duty, and two former police directors Albert Nushi and Nikollaq Palla.
Paplekaj has been sentenced to 22 years in prison, as he is suspected of being the author of the murder of Pjerin Xhuvani 4 days before the April 25 parliamentary elections in Elbasan.
Paplekaj did not appear in court, but sent a statement saying he does not want to participate.
"I want to be represented by av. Mirash Martini", writes Papleka.
The Court of Appeal found that the other accused are represented by the lawyers appointed by them. The court emphasized that the heirs of the victim Pjerin Xhuvani as well as their lawyer were notified, the latter requested to be notified at the address and not by phone. Even the injured police officer Xhensila Sota (as a victim in the incident) as well as Emiliano Prenga, Eltjon Bodinaku and Pavllo Vuksani did not appear.
The prosecutor of the case, Gent Xholi, said that "I exhausted the right and fastest ways to notify the lawyer of Pjerin Xhuvani's relatives. However, if the defense requires notification at the address we will do it formally and not over the phone
How did the event happen?
We recall that the sensational event in Elbasan happened 4 days before the April 2021 parliamentary elections, where Pjerin Xhuvani, a powerful local exponent connected to the Socialist Party, who was directly involved in the SP campaign in this city, was killed.
Pjerin Xhuvani was killed in Elbasan after being shot by Arbër Paplekaj, the companion of the head of the list of the Democratic Party, Gazment Bardhi.
From the April 21 event, four more people were injured, Emiljan Prenga, Pavlo Vuksani, Eltjon Bodinaku and Xhensila Sota (police employee). Paplekaj admitted the crime and surrendered to the RENEA Forces Department in Tirana, saying that he shot in self-defense after he was shot earlier by people who, according to him, were buying votes.
The event also revealed the PD scandal for the establishment of an armed group, self-proclaimed Structure for the Protection of the Vote, where a good part of its members turned out to be persons known to the law-enforcement structures in the country.
The gun clash happened because of the elections. The Vote Protection Structure set up by DP claimed that the SP headquarters car was caught handing out money in exchange for votes. After finding the car, the police were also called.
The deputy director of the Elbasan Police, Abert Nushi, and some members of the Eagles then arrived at the scene. After the arrival of the police, a vehicle with SP sympathizers arrived at the scene.
At this moment, the exchange of fire between the parties started. A few minutes after the event, former RENEA officer Arbër Paplekaj surrendered to the police, who allegedly shot at Xhuvan during the exchange of fire. The latter has repeatedly said that he shot in self-defense.
