
The members of the Independent Qualification Commission have addressed a request to the Assembly and the government, that after the end of their mandate in December of this year, they have the opportunity to become judges in the Court of Appeal.
Through an official request, they propose the same for legal advisors, who become part of the court and prosecution system.
They propose that for counselors who have practiced for 5 years in the KPK, the opportunity to be admitted to the school of magistracy for the profile of judge and prosecutor without competition is created.
As for counselors who have 4 years of experience, with their consent, be appointed BKH investigators.
"For the year 2024, our commitment is to complete the vetting for the remaining 10% of subjects that are undergoing this process earlier than December 31, 2024. This is in order for the decisions to be justified in writing by the adjudicating bodies and notified to the parties, guaranteeing the subjects and Public Commissioners the right to an effective appeal against the decisions of the Commissions and then forwarded for review to the Special College of Appeal, as the second final level of re-evaluation of judges and prosecutors.
But since 2024 is our last year, the lack of legal regulation of the status of the commissioners after the end remains a concern, which has brought legal uncertainty and no personal legal guarantee for the members of these constitutional institutions, as the Constitution recognizes them during the exercise of equalized in status with the member of the Supreme Court", states the request of the members of the Independent Qualification Commission.
The request was addressed to the Speaker of the Parliament, Lindita Nikolla, Prime Minister Edi Rama, Minister of Justice Ulsi Manja, the EU delegation and the American Embassy in Tirana.
