GJKKO's appeal accepts SPAK's request, decides to repeat the judicial

In the session for the Fier incinerator that has opened in the Court of Special Appeal, the judicial body has decided to repeat the judicial review in the Appeal. The appeal of GJKKO decided to accept the request of SPAK, for the repetition once again of the judicial review regarding the defendants accused of the Fier incinerator. 

The decision was given after the request of SPAK prosecutors and on the eve of hearing the defense of the accused. In the session at the GJKKO Appeal, which lasted about 2 hours and 30 minutes, the prosecutors requested the annulment of the decision of the first instance, regarding the acquittals granted to Arben Dervishaj, Juri Imeraj and Arjola Kodra, as well as to Alqi Ballko. who was found not guilty of abuse of office.

SPAK's request was opposed by the lawyers, but it was not taken into account by the Appeal of GjKKO. In the next session in the Special Appeal, several witnesses and the defendant Arjola Kodra will be questioned. The hearing will be held on November 7 at the GJKKO Appeal.

We remind you that in September of last year the Special Court gave the decision for the Fieri incinerator. The former Minister of the Environment, Lefter Koka, was sentenced to 10 years in prison and due to the shortened trial, he is sentenced to 6 years and 8 months.

He is accused of corruption, abuse of office and money laundering during the contracting and construction of the Fier incinerator.

For his former General Secretary in the Ministry of Environment, at the same time former deputy of SP, Alqi Blako, the court gave a sentence of 4 years in prison, 3 years less than the sentence requested by SPAK. For him, the court requalified the charge, removing his cooperation from "abuse of duty".

Lefter Koka: 10 years in prison, because of the shortened trial he is sentenced to 6 years and 8 months

Alqi Blako: 4 years in prison, due to the shortened trial he is sentenced to 2 years and 8 months

Klodian Zoto: 12 years in prison, because of the shortened trial he is sentenced to 8 years

Arben Dervishaj is declared innocent

Arjola Kodra is declared innocent

Pellumb Abeshi: 3 years and 6 months in prison, due to the shortened trial he is sentenced to 2 years and 4 months

Florian Muçaj: 3 years in prison, due to the shortened trial he is sentenced to 2 years


Azem Shatëri: 3 years in prison, due to the shortened trial he is sentenced to 2 years

Erjon Murataj: 3 years in prison, due to the shortened trial he is sentenced to 2 years

Sabina Cenameri: 3 years in prison (suspension of sentence, because she has a minor child)

Loran Dusha: 7 years in prison, due to a shortened trial he is sentenced to 4 years and 8 months

Arbër Denizi: 7 years in prison, due to the shortened trial he is sentenced to 4 years and 8 months

Juri Imeraj is declared innocent

Regan Merdani: 3 years in prison (suspension of sentence)

Gentian Zifla: 3 years in prison (suspension of sentence)

The businessman who owns the concessionary company of the Fier incinerator, Klodian Zoto, was sentenced to 12 years in prison. Of the 4 charges of "corruption", Zoto pleaded guilty to only one of them, while he was also found guilty of "fraud with serious consequences", "creating fraudulent schemes" and "money laundering".

The defendant Arben Dervishaj, former vice-president of the AFF, supervisor of the works at the incinerator, was acquitted of both charges. The court ordered his immediate release from the cell. The defendants Arjola Kodra and Juri Imeraj were also acquitted of all charges.

The court also ordered the release of 5 other defendants, mostly former members of the Concession Granting Commission, from the detention cells. Although sentences ranging from 3 to 3 years and 5 months in prison were given to them, the suspension of the prison sentence was decided, or the time spent in detention was greater than the sentence given.

The concessionaire company of the Fier incinerator, "Integrated Technology Services" sh.pk, defendant as a legal entity in the process, declared not guilty and the court released it from the sequestration measure.

Regarding the requests for confiscation, the Special Court accepted the request of SPAK only for a "unit" property with an area of ​​789 m2 belonging to the defendant Lefter Koka. All other blocked assets, including 3 real estates of Koka and an apartment of Alqi Bllakos, were released from the seizure measure.

According to the Special Prosecutor's Office, for favoring the concessionaire company, former minister Lefter Koka received 1.2 million euros in bribes, while the defendant Alqi Blako received 14 million lek. While the concessionaire company was accused of having benefited through fraud of 4 million euros from the state budget.
