The judges of the Republic of Albania have issued a joint statement today, after a meeting held in Tirana, following the serious incident that occurred on October 6, where the judge of the Court of Appeal of General Jurisdiction, Astrit Kalaja, was killed in the line of duty.
The statement, read by Judge Albana Boksi, emphasized that this event is not only a human loss, but a blow to the justice system and the rule of law itself. According to her, “politics must stop the language of attacks and hatred towards justice,” while the High Judicial Council must fulfill its institutional obligations without delay.
In the statement read out publicly, the judges emphasize that the climate of attacks, insults and threats against judges has created an unsafe and unacceptable environment for the exercise of judicial function. They called for concrete measures to increase security in the courts, including the creation of a special security force, the development of incident response protocols, and the adoption of a national strategy for the construction and equipping of court buildings.
The joint document also proposes the creation of a National Forum for Judicial Security, the drafting of a national platform for the protection of judges, and the involvement of relevant institutions in this process, such as the Ministry of Justice, the Ministry of Interior, the Supreme Court of Justice, the Supreme Court of Justice, and the State Police.
At the institutional level, the judges requested the Supreme Court of Justice to exercise its constitutional mandate with more determination, while the Assembly and the Government, to adopt measures to improve working conditions in the courts and guarantee the physical security of judges and judicial staff.
In honor of Judge Astrit Kalaja, it was requested that he be recognized with the status of "Martyr of the Homeland", while the meeting room at the Supreme Court of Kosovo be named after him.
The judges stated that they will not allow silence to be interpreted as weakness, emphasizing that the independence of the judiciary is not a privilege, but a guarantee for citizens. The statement concludes with a pledge that the judicial system will continue to work with impartiality and integrity, despite the challenges it is experiencing.
DECLARATION OF THE JUDGES OF THE REPUBLIC OF ALBANIA
On this difficult day for Albanian justice, the judges of the Republic, united in one voice, express deep pain, human shock and institutional indignation for the tragic event that took the life of our colleague, Judge Astrit Kalaja.
Kjo nuk është vetëm humbja e një njeriu të drejtësisë — është një plagë për gjithë sistemin, një goditje ndaj shtetit të së drejtës dhe një sulm ndaj pavarësisë së gjyqësorit. Vrasja e një gjyqtari në sallen e gjykimit është kufiri i fundit i cenimit të sigurisë dhe dinjitetit të drejtësisë.
Në këtë moment dhimbjeje e reflektimi, ne deklarojmë me vendosmëri:
Drejtësia nuk do të përkulet.
Asnjë akt dhune, kërcënimi apo fushatë urrejtjeje nuk do ta ndalë gjyqtarin shqiptar nga përmbushja e detyrës së tij kushtetuese. Pavarësia e gjyqësorit nuk është privilegj, por garanci për çdo qytetar që kërkon mbrojtje përmes ligjit.
Ngjarja e rëndë është pasojë e një klime të helmuar fyerjesh dhe kërcënimesh ndaj gjyqtarëve, e ushqyer nga gjuha e urrejtjes dhe ndërhyrjet e papërgjegjshme që kanë minuar besimin publik. Kjo klimë duhet të marrë fund.
Ne, gjyqtarët e Republikës, nuk do të lejojmë më që heshtja të interpretohet si dobësi. Do të reagojmë me dinjitet dhe përgjegjësi. Nuk kërkojmë privilegje — kërkojmë siguri, respekt dhe kushte për ushtrimin e ndershëm të detyrës.
Kjo ngjarje është një thirrje për veprim institucional. Sistemi gjyqësor po përballet me mungesë sigurie, godina të amortizuara, ngarkesë të papërballueshme pune dhe mungesë mbështetjeje. Drejtësia ka nevojë për forcim, për kushte të sigurta dhe për institucione që veprojnë, jo që heshtin.
Këshilli i Lartë Gjyqësor duhet të reagojë me forcë, përgjegjësi dhe guxim institucional. Kjo nuk është thirrje për konflikt, por për përgjegjësi. Po kështu, pushteti ekzekutiv dhe legjislativ duhet të marrin përgjegjësinë për gjendjen ku ndodhet sot drejtësia. Shteti nuk mund të kërkojë drejtësi të pavarur, nëse nuk garanton kushtet minimale për ushtrimin e saj. Siguria në gjykata është kusht për ekzistencën e shtetit të së drejtës.
Në këtë frymë reflektimi dhe uniteti Mbledhja e Gjyqtareve të RSH shpreh vullentin e qartë mbi këto angazhime:
1. Siguria gjyqësore
- Krijimi i një Grupi Ndërinstitucional me përfaqësim nga KLGJ, KLP, MD, MB, Polica e Shtetit dhe agjencitë e tjera ligjzbatuese për organizimin e një Forumi Kombëtar për Sigurinë Gjyqësore.
- Hartimi i një Platforme Kombëtare për Sigurinë e Gjyqtarëve dhe Gjykatave.
- Vendosja e një force të posaçme sigurie në gjykata dhe ndërtimi i protokolleve të reagimit ndaj incidenteve.
-Hartimi dhe zbatimi i një Platforme Kombëtare për Sigurinë Gjyqësore.
-Miratimi dhe zbatimi i menjëhershëm i masave konkrete për garantimin e sigurisë fizike në gjykatë dhe kushteve të ushtrimit të funksionit gjyqësor.
-Ndërhyrje të menjëhershme në ligjet ose aktet nënligjore që rregullojnë sistemin gjyqësor për të garantuar siguri fizike, jetësore, shëndetësore dhe pasurore për gjyqtarët dhe stafin e gjykatave.
-Miratimin e një strategjie kombëtare për ndërtimin e godinave të gjykatave në të gjithë territorin e RSH.
-National inspection of courts for security, access and working conditions. Standardization of security procedures and training for crisis management. Equipping all courts with scanners and detectors to guarantee security in the courts.
2. Institutional representation and internal organization
- Creation of two permanent working groups within the High Judicial Council to devise an initiative for amendments to legal and sub-legal acts regarding the status of magistrates and the organization of the judicial system.
- Public awareness and cooperation with the media.
- Promotion of professional communication that avoids denigrating language. Rejection of hate speech, insults and threats as normality in public and political discourse towards judges.
- Institutional responsibility and action
- Encouragement for the Supreme Court to exercise its constitutional mandate forcefully.
- Request that the Parliament and the Government take concrete measures to improve working conditions in the courts.
- Moral and professional commitments of judges
- Commitment to timely judgment, reasoned decisions and consistency in jurisprudence.
- Acceptance of responsibility for the internal strengthening of the system as the foundation of the moral authority of justice.
3. In memory of the judge who fell in the line of duty, Astrit Kalaja
-Recognition of the status of "Martyr of the Homeland" to Judge Astrit Kalaja.
-The Judges' Meeting Hall near the High Court of Justice building will be named after the late judge Astrit Kalaja.
The October 6th event should not remain a painful memory, but a moment of national awakening for Albanian justice.
We are not asking for pity — we are asking for action.
Because an unprotected judge is an unprotected justice, and an unprotected justice is a citizen without hope.
We solemnly commit ourselves to continuing to judge with impartiality, honesty, and courage, despite the shock.
Albanian justice does not surrender, it rises again.
Justice will not be stopped.
It will continue to act courageously to protect the freedom, rights and dignity of every Albanian citizen.
