Debate in Selim's trial on the 'act of expertise with errors'

The expert report initially requested by the Special Prosecutor's Office for the estate of the former judge of the Supreme Court, Shkëlzen Selimi, was dealt with in most of the session on Thursday, November 16, amid discussions and debates, when the defendant addressed several questions. to the accounting expert, who admitted that she had made a mistake in calculating the expenses.

Although the prosecutor of the criminal case in charge of Selim, Doloreza Musabelliu, observed that this act of expertise was not related to the case, since it was not taken as a basis in the notification of the charge that a re-expertise was carried out, the court allowed the continuation of the questions and finally gave her time to the accounting expert, Lindita Muça, to re-read the expert report drawn up by her so that she could give complete answers. Selimi called the handling of the expertise report important, with the argument that based on this document, his assets were seized.

Former judge Selimi is in judicial proceedings for the criminal offense of false declaration of wealth based on an investigation launched three years ago by SPAK.

When the court gave the floor to the expert Muça, she said that she wanted to clarify a mistake she had made in the financial analysis. However, judge Rudina Palloj requested the continuation of the questions from the defendant and his defenders, his wife, Rilinda Selimi and lawyer Ylli Manjani.

Several times, Judge Palloj asked the parties not to discuss and argue with each other, but to continue calmly, noting that the court is not there to relieve tensions.

In response to the questions of Selim and his defenders, the expert Muca stated, among other things, that she had incorrectly calculated the value of the expenses, noting 51 million ALL from the 30.8 million ALL that is according to her. She justified herself by showing that she had a family problem that had shocked her and therefore she had not reviewed the expert report at the time when she handed it over to the prosecutor's office.

From what was stated by those present at the hearing, it was learned that the defendant had denounced the expert for the act she had committed. Former judge Selimi claimed at one point that the expert was under oath and that her statements were needed for another country. Judge Palloj drew Selim's attention, requesting that there be no threats in the courtroom.

After being followed for about an hour and a half with questions and incomplete answers by the expert, the latter asked for time to read the act drawn up by her. Judge Palloj stated that she decided to give the expert time to refresh her memory.

The other witness who was summoned to be questioned, the lawyer Fran Dashi, who had also filed the complaint, was not notified. The court repeated his announcement, also requesting the cooperation of the officers of the National Bureau of Investigation.

At the end of the hearing, the defendant submitted all the documentation of his and his wife's case to the Special Appeal Board as evidence. Prosecutor Musabelliu called them unnecessary, noting that the decisions have been administered, while Selimi pointed out that the court had overturned a decision of the prosecutor's office demanding that all acts of the administrative investigation be administered by veting institutions. Similarly, similar lease contracts and the decision to terminate the investigation for other re-evaluation subjects of the same criminal proceedings with Selim were filed, documents that were administered by the court.

In the end, it was decided to postpone the session until December 6, at 09:00. / BIRN
