The General Prosecutor's Office complained on Friday to the Assembly that the treasury account has been blocked by the bailiffs, as a result of non-payment of the obligations for the salary supplements of the employees according to the decision of the Constitutional Court.

Luan Abazi, the General Secretary of the General Prosecutor's Office, told the Parliamentary Committee on Laws that "we have had a lot of difficulty in carrying out financial actions with the treasury, because the treasury has been blocked by the bailiffs".

During the presentation of the new budget, Abazi asked the government to take measures on this issue, as according to him, "court proceedings continue and the court is systematically giving decisions in their favor".

"From our side, the obligation for all employees has been recognized, this was done to save court and enforcement costs," he added, assessing the situation as very problematic.

"The Ministry of Finance should be asked to decide that this obligation we have should be liquidated immediately, because the prosecutor's office is in daily difficulty to carry out actions in the constitutional function it has," he insisted.

The decision of the Constitutional Court announced a year ago recognized a salary increase of 14 thousand ALL to all magistrates since 2019, but the government has turned a deaf ear to the allocation of funds for its implementation.

The same concern was raised by the Special Structure against Corruption and Organized Crime, SPAK, during the hearing in this committee on Friday.

Armand Shini, director of the Budget and Financial Management in SPAK, said that "the structure is facing judicial decisions that are being executed and judicial, executive expenses", demanding that a solution be found.

According to him, the financial effect of these obligations amounts to ALL 130 million for this institution.

During the requests for the new 2024 budget, the head of SPAK, Altin Dumani, insisted that the government foresee the amount of investments in the amount of 550 million for the reconstruction of the new building within the coming year, not divided into 2 years, as it had provided by the Ministry of Finance.

"We are faced with the fact that we have the building in front of us, but we are working beyond capacity and we cannot complete the staff as we do not have premises to put them," Dumani told the deputies.

Regarding the obligations for salary supplements, the head of the Laws Commission, Klotilda Bushka, said that the concern was right, but she reiterated the position that the Assembly and the government are looking for an institutional-legal solution to this issue

The employees of the justice bodies are massively winning the trials for the implementation of this decision, putting their operation in a financial deadlock and adding to their financial obligations and judicial and enforcement expenses.

During the budget hearings, the High Judicial Council, the High Prosecution Council, the Independent Qualification Commission and the Independent Appeals Commission emphasized that this was a sensitive issue for the performance of the work and for the independence of these institutions. / BIRN
