Will the “Partizani” case go to trial or not? After 6 months of

Flojera Davidhi must decide on the fate of the "Partizani" file tomorrow

After six months of delays, the Special Court is expected to decide tomorrow whether or not to proceed with the “Partizani” case. Judge Flojera Davidhi has not made a decision since December, and the final decision is likely to be made tomorrow at 1:00 p.m.

In the preliminary hearing at the GJKKO, the defense lawyers of all the defendants were present, including lawyer Luan Hasneziri, the legal representative of the company "Homeplan", who was absent from the last hearing for health reasons.

Hasneziri, like the other defense attorneys, has requested the case be dismissed with the argument that there is no criminal offense. On the other hand, SPAK is requesting that the file be sent to trial.

Meanwhile, other lawyers have also requested the invalidation of some of SPAK's evidence. Regarding this request, Judge Fjorela Davidhi decided to dismiss the request. The hearing was postponed to tomorrow at 13.00 and it is expected that tomorrow we will have a final decision on whether the file will be returned, will we have a trial or a break for the investigations.

The passage of this file for trial would mark the first confrontation of Sali Berisha and Jamarbër Malltez with justice. The former prime minister is currently under "compulsory appearance" security measure on charges of passive corruption, while his son-in-law is under "house arrest" on charges of passive corruption and money laundering.

Along with Berisha and Malltez, their associates, businessman Fatmir Bektashi, are also charged with “active corruption” and “money laundering”. The charge of “money laundering” has also been communicated to Malltez’s partner, Xhimi Begeja, heir to the land and co-owner of ‘Homeplan’, as well as Andia Pustina, the financier who carried out all of Homeplan’s financial and legal operations. Together with these last three persons, their trading companies Studio Pustina sh.pk, Homeplan sh.pk and Kontakt sh.pk have also been charged with money laundering.

Sali Berisha and Malltezi have been charged with abuses in the privatization of properties in the former "Partizani" Complex. The prosecution states that the former prime minister has committed the criminal offense of "Passive Corruption of High State Officials or Local Elected Officials" provided for in Article 260 and 25 of the Criminal Code.

Meanwhile, Malltezi is suspected of having committed the criminal offense of "Passive corruption of high-ranking state officials or local elected officials."

" In his capacity as Prime Minister of the Republic of Albania, concrete and active actions have been taken, in approving laws or bylaws, with the aim of adapting them to the needs that arose for the five known owner families, where the direct winner, among others, turned out to be the husband of his daughter, citizen JM. On the part of citizen SB, in his capacity as Prime Minister of the Republic of Albania, active actions have been taken to carry out administrative controls, with the aim of exerting pressure and issuing concrete orders, for the conclusion of privatization procedures, in favor, among others, of citizen JM, his daughter's husband ," SPAK states for Berisha.

As for Malltezi, the prosecution states in the file that: The privatization of sports grounds and facilities was done with the sole purpose of getting hold of them, changing their destination and using them for material benefits by Malltezi;  

The changes made regarding the destination of the areas from sports to residential, which has led to the completion of constructions, from which Malltezi has directly benefited, continues SPAK.

All monetary benefits that Malltezi received in his capacity as an investor from the company "Homeplan" sh.pk, without investing in the latter, benefits received before being declared as a spouse in this company, the profits accumulated over the years of this company as well as those distributed subsequently, after 2018, calculated in total at the amount of 672,976,832 lek or 5,420,345 euros. /Pamphlet
