The Constitutional Court ruled in favor of journalist Elton Qyno in the legal battle with the Special Prosecution Office for the protection of the source of information.
Lawyer Dorian Matlija said that the Constitutional Court's decision for journalist Qyno set an important standard. He added that this decision showed that freedom of expression is one of the most delicate rights that must be protected.
"The Constitutional Court's decision has already strengthened the protection of journalists. It is not that we were without such protection, because the Supreme Court in 2021 in the Lapsi case made a similar decision, but apparently it was not strong enough to put a stop to a new structure such as SPAK. It was an even higher standard to show this special structure that there are limits, that freedom of expression is one of the most delicate rights that must be protected and the ways in which SPAK acted in this specific case and the way in which the court of first, second instance and the Supreme Court allowed it, crossed the limits set by the Constitution and the European Convention on Human Rights ," lawyer Matlija told "Report TV".
The lawyer also said that there should have been a disciplinary investigation into the magistrates implicated in the Qynos case. According to him, the journalist's materials were seized brutally and without the presence of his lawyer.
