
The trial against former Prime Minister Sali Berisha and his son-in-law, Jamarbër Malltezi, in the 'Partizani' case will proceed to trial on the merits with the usual procedure, i.e. not with a summary trial. This was confirmed by former Prime Minister Berisha's lawyer, Genc Gjokutaj, after the GJKKO decided today to proceed to trial with the Partizani case, where 5 people are defendants.
Gjokutaj described the GJKKO's decision to send the file for trial as dictated by Edi Rama.
"Today was the last session, where the decision you just mentioned was made. We filed a motion for the invalidation of all acts of Judge Irena Gjoka during the preliminary investigation."
She did not have the qualifications to be a judge, the decisions she made were invalid. This judge dismissed the requests without providing any arguments.
The judge decided to proceed with the trial. This judge, under the same conditions in the Dako case, dismissed the case for additional investigation without the party's request, while in this specific case, she proceeded with the trial.
This illegality has been keeping Jamarbër Malltez under house arrest for 2 years. Rama, through the GJKKO, also carried out this phase to send the case to court.
It was a quote from provisions of articles that I think are for students about what will be done, the file will go there, a draw will be made and it just didn't say that it will rain or shine that day. We have not requested a summary trial, because there is no criminal fact, and secondly, the moment it establishes invalid and unusable acts, the summary trial is automatically overturned.
This court validated those acts and sent them to trial, but we have our own reading of the law, letter by letter, page by page.
We have also filed a report, there is no rift in their ranks here, because the case is flagrant. On the part of the judge, for both professional and ethical reasons, she should have given her version, an explanation, or taken some action to leave.
"It's better when you walk away on your own feet than when they take you away. We are continuing, we also have our strategy, we are fighting on a terrain where there are no eyes that see and no ears that hear," said Gjokutaj.
