
The judiciary refuses to send experts to the "Xhafaj" commission...
The bodies of justice have all come out against the famous "Xhafaj" commission. The latter tried to make the new bodies of justice part of the game, but it is learned that they all turned against him, as they refused to send experts to the commission.
Initially, it was SPAK that informed the commission that they will not be part of it, as they have stated their demands and can be part of a law-making process.

Unanimously, all the Special Prosecutors did not consider it necessary to participate with an expert in this Commission, as they assessed that our institution has already fulfilled its legal obligations for making public the problems encountered during the exercise of its functions, including the needs for relevant legal changes. This legal obligation has been realized through the publication of SPAK's Annual Reports on the official website, as well as periodic reports to the KLP and the Assembly. On the other hand, the Special Prosecutor's Office stated that it is ready to offer its contribution through the provision of legal opinions whenever it is considered necessary by this Commission ", announces SPAK.
The General Prosecutor, Olsian Çela, was on the same line. It is learned that the latter initially planned to send the two prosecutors Kosta Beluri and Arqile Koça to the commission as senior experts, but then it is learned that he withdrew, maintaining a refusal attitude.
Likewise, the High Inspector of Justice and the Constitutional Court have taken the same position. It is learned that both institutions have addressed the commission, where they inform it that they will not send experts.
Recently, the Supreme Court also reacted, which maintained the same line. This body refuses to be part of the plan to capture the reform, as it announces that they are ready to give supporting opinions, but the request to be part does not fit their function.
" Bearing in mind this function of the Supreme Court in relation to other powers, we estimate that your request for the direct participation of the judges of this Court as members of a technical subgroup, depending on the High Level Expert Group of the Commission of Specially, which must perform the assigned tasks according to the decision-making of the Commission, does not fit with the function and mission of the judge. As such, it is not considered as an appropriate solution in fulfilling the mission of the Special Commission. Of course, the Supreme Court welcomes the opportunity to give opinions on draft laws that are directly related to its function. We are pleased to note that the practice of recent years has shown that proposals for some changes in civil, criminal and administrative procedural laws, in order to increase the efficiency of the trial and prevent of the creation of new stock, approved by the Assembly with the contribution of the judges and legal advisors of the Supreme Court (independently and without being part of the commissions or subcommittees set up for this purpose at the Assembly), has had a positive impact on the direction of the speed and quality of the adjudication of appeals ", states the Supreme Court. / Pamphlet
