The 40 migrants transferred to Albania on Friday from Italy will return to the country across the Adriatic before being repatriated to their countries of origin, Italian Interior Minister Mattei Piantedosi said.
"Based on their nationality and agreements with their countries of origin, some people will initially have to return to Italy," he said.
According to Italian media, the Interior Ministry has announced that the 40 immigrants will have to return to Italy, because, as is known, there is no agreement with Albania on the execution of deportations, without which no one can be repatriated from a third country.
In this context, the Italian media describes the transfer of migrants to the Gjadri camp as a useless and costly 'carousel', with which the Meloni government is trying to save face after the failure of the 700 million euro protocol to examine asylum requests in Albania from applicants coming from "safe" countries.
After the approval of the March 28 decree, the Gjadri camp took on the function of a CPR, where irregular migrants awaiting repatriation are housed.
Italian media say that it is still unknown to what nationality the 40 people transferred to the Gjadri camp belong.
Regarding the way they were selected, Piantedosi said that "all 40 people were subject to a detention order, since according to the law, the condition of administrative irregularity was also added to the assessment of dangerousness."
Among the transported persons are 5 cases of conviction for sexual violence, one case of attempted murder, crimes against property, theft, and opposition to a public official.
But there are also people without criminal records, reports the delegation of the Asylum and Immigration Committee that welcomed them at the center on Saturday afternoon.
There are also people who have not been able to renew their residence permit, as can also be found in the Italian CPRs.
And yet, what does all this have to do with temporary displacement in Albania? Nothing.
Criminal profiling, in fact, does not eliminate the risk of discrimination censured by Article 3 of the Constitution, which arises when the law “without reasonable cause” provides for different treatment between those who are in “equal situations” (Constitutional Court Decision no. 15/1960).
Furthermore, nothing is specified about the selection criteria for persons to be transferred to Albania: decree 37/2025 says nothing.

"The methods of validation and exercise of the right to defense are very different, and worse, compared to what happens to detained persons in Italy," denounced the Association for Legal Studies on Immigration (ASGI), which points out several profiles of unconstitutionality.
"What are the selection criteria, on the basis of which rules are they identified and who does it?"
"Is it the ministry that makes this choice and increases the relative responsibility?" asks lawyer Dario Belluçio.
These people will be prevented from visiting relatives, they will not have the opportunity to meet with lawyers, while the ministry autonomously determines the change of judge who will have to decide the fate of the case."
