Ervin Salianji's lawyer, Ledio Braho, commented in an interview with Euronews Albania on the conditional release of the former MP, emphasizing that it was a predictable and fair step, as all relevant institutions, including the Fier Penitentiary Institution and the Probation Service, had a positive attitude towards the request for release.
Braho stressed that there was no reason to penalize Salianji and considered this more of a procedural issue than a matter of law.
He also spoke about the legal issue related to the delay in decisions by the Supreme Court and considered this an obstacle to advancing the case to the Constitutional Court and then to Strasbourg.
"It was normal for him to receive conditional release. The Fier Penitentiary Institution had a positive stance, the probation service had a positive stance, so the prosecutor would have had one too, if not, there had to be an argument because it would look like a political revenge."
In every case of conditional release, it is treated according to what the individual represents and Salianji did not have any of those conditions that should have penalized him for his request not to be accepted, today I consider this a procedural and not a legal issue.
"As for the fact that it will be addressed to Strasbourg, the next step is the Constitutional Court because without being consumed, this step cannot go to Strasbourg. The problem is that we have not received a reasoned decision from the Supreme Court for 4 months and this prevents us from going to the Constitutional Court. These are the vicissitudes of this issue, such decision-making is without justification," he said.
Braho emphasized that there were constitutional violations during this process, including the lack of an impartial court and the failure to respect certain legal norms.
"We have several constitutional violations in this process, starting with the court not being in the conditions of an impartial court, a court established by law, other legal issues have not been respected, so there are a number of constitutional violations in the Salijanj case," said Braho.
