Former Prosecutor of Serious Crimes Eugen Beci commented on the interpretation of the Venice Commission regarding the mandate of MP Olta Xhaçka.

According to him, from the procedural point of view, Venice has given an exhaustive answer when it says that the decisions of the Constitution are binding both for the deputies and for the Assembly of Albania.

Beci stated that the Constitutional Court should not have brought the country into this impasse by taking a case to Venice for which it should have given an exhaustive answer.

" We are dealing with procedure and matter, the Venice Commission has given an exhaustive answer to the procedure, which says that the decisions of the Constitution are binding for the deputies and the Assembly of Albania. In the Republic of Albania, the only superior body that interprets the Constitution is the Constitutional Court and the decisions of this court are binding, because Venice explains precisely that the separation of powers, loyalty to the rule of law means the fact that the Parliament of the Republic of Albania has powers that are not are related to the removal or not of the mandate. Given that in the Constitution, the mandate of a deputy is found to be incompatible only by the Constitutional Court, the deputies of the Assembly have only one solution, to vote on the constitutional decisions because, otherwise, the concept of separation and independence of powers falls. The Constitutional Court should not have led the country to this impasse to make fun of Venice with the Republic of Albania, but to say whether or not there is incompatibility, whether the mandate is terminated or not. The answer should have been exhaustive ", he said on the show Now, on Euronews Albania.
