Former Minister of Defense, Fatmir Mediu, has filed a request to exclude Judge Irena Gjoka from the substantive review of the "Gërdeci" case, in which he is a defendant.
The request was filed through his defense team, which refers to a decision of the Supreme Court of July 2025. According to Mediu's lawyer, this decision sanctions that a judge who participated in the preliminary phase of criminal proceedings cannot be part of the trial panel in examining the merits of the case, except in cases where the case is conducted in a summary trial.
The defense argues that in this specific case, the trial against the former minister is being conducted under ordinary procedure, which, according to it, creates a legal incompatibility for the trial to continue before the same judge.
The request for disqualification is expected to be reviewed by the competent judicial body, which will decide whether the claims presented by the defense are well-founded and whether there will be a change in the composition of the trial panel.
