Former Defense Minister Fatmir Mediu attacked the Durda family in the courtroom for the Grëdec masquerade and demanded their removal from the courtroom.
The medium told the Durda family that they have been listening to them for 15 years, at a time when they are seeking justice for their murdered minor son.
But, after Mediu's words, Mrs. Durda said that they were the ones who had been waiting for 15 years for justice, as she tearfully expressed that today their son would have been 25 years old.
Excerpts from the debate:
Defense of Mediu, Visha: Madam Judge, we request that you provide us with the audio of today's session and we request your exclusion from the trial of this case, due to your behavior and failure to take measures against the victim of the criminal offense in this session, as well as the adjournment of the session for today.
Ligori: We can't continue, here it's not just the defense forces that have been insulted, but the entire justice system. You didn't react to take measures. We can't continue.
Media: I can't understand how we can continue this session.
Ligori: We are technically ready, but we are not morally ready. If a party in this process tells the defense that "they don't even consider you a garbage collector," we cannot continue this session.
Court: Your request for my exclusion is not a reason for not continuing the judicial process.
Ligori: We are not ready to continue the session because we are not here to be treated like lectures.
Prosecutor: As for the victims to be legitimized in this process, there is also the Strasbourg decision, which has given you the right, if they need to be present. We ask the court to administer some new evidence, which came to us later, we ask for a series of documents to be administered. Maybe this is not the procedural moment, but they arrived late. The decision of the Strasbourg Court is also based on these documents. We ask the court to allow them as evidence and then we will also provide explanations why we have this request. Regarding the request for protection, Acts from foreign authorities are administered only after the court's request. Their testimonies should be brought to the court only if the court would have accepted them as witnesses. In this case, I ask the court to dismiss the request.
Mediu's Defense: The prosecution's position has nothing to do with our case. The victim of the criminal offense does not have equal rights with us in this judicial process.
Dorian Matlia, the victims' lawyer: Your Honor, a parenthesis, the person will leave the courtroom. We are trying to develop the process.
Geraldo Durda leaves the courtroom after the clash he had in the courtroom with Mediu's lawyer, Ardian Visha.
Ferizan Durda: Don't tell me 15 years that I'm the one who's been enduring. That my child would be 25 to 26 years old today as we speak. He bursts into tears. After the tensions in the courtroom.
Matlia: The Strasbourg Court has said that there are procedural violations in the trial due to not allowing the victims to be part of this process. The Strasbourg Court has said it very clearly in its decision. Strasbourg has clearly said effective participation. I would like the court to say that comments made by the party without relevance to this trial do not need to be made in this courtroom, they can be made outside.
Mediu: Madam Judge, what is happening in this courtroom is being done with the intention of linking the Gerdec explosion to Fatmir Mediu. This is not justice, I also have the right to explain my position. I have no problem with the presence or if they ask me, but I cannot accept that politics be played on this issue. I explained the request for witnesses at the beginning of the hearing, if the prosecution wanted to do justice, it should have investigated properly. These witnesses are very important for us and for my defense. These generals have taught us how to dismantle weapons. This is not just a trial.
