GJKKO sentences Fran Marashi to life imprisonment; how 5 policemen were killed

Marashi was extradited from Italy in 2007, while in 2009 he attempted to escape from Burrel prison together with Preng Lleshi, another member of the Ura Vajgurore gang, to draw attention to the fact that the process against him should be reopened.

The GJKKO has sentenced Fran Marashi, one of the gang members accused of carrying out the Vajgurore Bridge massacre in 1997, in which five police officers were killed, to life in prison. The police vehicle was attacked with heavy weapons, including an anti-tank gun, in what is considered one of the most serious incidents to have occurred 28 years ago.

The trial of Fran Marashi took place at the GJKKO, which took over the retrial of one of the most serious events that occurred in the disastrous year of 1997.

After the retrial of the case, prosecutor Alfred Shehu in his final conclusions requested life imprisonment for Fran Marashi.

For this event, the courts have previously handed down 3 life sentences.

Fran Marashi, sentenced in absentia to life imprisonment for the massacre, was retried at the GJKKO after the Supreme Court decided to return the case to the first instance.

Marashi was extradited from Italy in 2007, while in 2009 he attempted to escape from Burrel prison together with Preng Lleshi, another member of the Ura Vajgurore gang, to draw attention to the fact that the process against him should be reopened.

In December 2024, Fran Marashi was placed in the "41-Bis" regime, in the high-security Institution for the Execution of Criminal Decisions in Peqin for a period of one year.

Decision from the GJKKO

1. On 19.09.2023, the criminal case against the defendant Fran Marashi was submitted for trial to the Special Court of First Instance for Corruption and Organized Crime.

2. The trial of this case was conducted under the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Erjon Bani, Flora Hajredinaj and Flojera Davidhi, with decision No. 21, dated 10.03.2025, decided:

1. The guilty plea of ​​the defendant Fran Marashi for committing the criminal offense of "Creating an armed gang and criminal organization", in the form of participation in an armed gang, provided for by Article 333 of the Criminal Code (Law No. 7895 dated 27.01.1995) and, based on this article, his sentence to 10 (ten) years of imprisonment.

2. The guilty plea of ​​the defendant Fran Marashi for committing the criminal offense of "Intentional Murder", to the detriment of the victim IB, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 76 of the Criminal Code (Law No. 7895 dated 27.01.1995), in connection with Articles 28 paragraphs 1, 3 and 4 and 334 paragraph 1 of the Criminal Code (Law No. 7895 dated 27.01.1995) and his sentence to 20 (twenty) years of imprisonment.

7. 8. 9. The guilty plea of ​​the defendant Fran Marashi for committing the criminal offense of "Unlawful Deprivation of Liberty", to the detriment of the victim KB, committed in collaboration with the special form of collaboration of the "Armed Gang", provided for by Article 110 paragraph 2 of the Criminal Code (Law No. 7895 dated 27.01.1995), in connection with Article 28 paragraphs 1, 3 and 4 of the Criminal Code and with Article 334 point "I" of the Criminal Code (Law No. 7895 dated 27.01.1995), and his sentence to 8 (eight) years of imprisonment.

10. Based on Article 55 of the Criminal Code in the concurrence of sentences, the defendant Fran Marashi is ultimately sentenced to a single sentence of life imprisonment.

What happened in 1997?

Fran Marashi is accused of the incident of June 17, 1997, where five police officers were killed and 6 others were injured.

After a Socialist Party rally, police forces were returning to Berat in their vehicles when they were shot at 150-200 meters from the Protoduarëv villa. The police armored vehicle lowered its hood and headed towards the square in the city center, but before it had gone 50-60 meters, it was hit by an anti-tank shell from the Protoduarëv villa.

Eyewitness Lulzim Nexhipi said that at this moment bottles of fuel were thrown at the police van and Lek Lorja and Fran Marashi were seen getting into the tank. After this, two powerful shots were heard and the van caught fire, resulting in the deaths of police officers Miltiadh Koçi, Arjan Shemuni, Asllan Selami and Ilia Bano, who were burned inside the van, and two police officers Thimi Tanku and Ylli Dhamo, who were injured.

The shooting also killed citizen Ilir Bani, who happened to be there at the time. According to the prosecution, the perpetrators of the crime were members of the gang led by the Protoduari family based in the latter's villa in Berat. After opening the warehouses, this gang, also connected to the local police, had committed criminal offenses such as violent robbery as its armed members set up checkpoints throughout the city, taking money from citizens under threat of killing them.
