Jamarbër Malltezi has appealed the decision of GJKKO that issued the security measure of "prison arrest" against him.
The son-in-law of former Prime Minister Sali Berisha was arrested by the authorities on October 21 at Rinas airport , while he is accused of corruption and money laundering related to the privatization of the former "Partizani" sports complex in the capital.
For Jamarbër Malltez, the order was given for the sequestration of his assets, including apartments in the area where the former sports complex was located.
The son-in-law of former Prime Minister Sali Berisha is accused of passive corruption in collaboration and money laundering in connection with the privatization of the former Partizani complex.
On October 23, the Special Court decided to leave Malltez's prison sentence in effect.
Jamarbër Malltezi asked for the cancellation of the security measure, while his lawyers claimed that there is no criminal offense.
But the trial body did not consider these requests. After the session, Malltez's lawyer, Klodian Skenderi, said that this decision violates the principle of legal certainty and that the evidence is of a low standard.
'Our position is that there is no criminal offense in this particular case. The persons under investigation are facing a pure legal-civil relationship. It cannot be alluded to by means of laws or VKM, which have not even been contested, to claim the commission of criminal offenses. Our position with the attributed accusations, a denial position, I say this with conviction as far as we could see the fascicles. Accusing someone because he is a legal heir of a tyrannical family, such as Begeja, and that he entered into contractual relations with another heir of another tyrannical family, is very bold. The standard of proof is very low and with these hints, the principle of legal certainty is being violated here in this country, said Klodian Skenderi, the lawyer of Jamarbër Malltez.
Even for the builder Fatmir Bektashi, the security measure of compulsory appearance and ban on leaving the country was left in force.
