GJKKO ousts Lefter Koka, former minister remains in prison

The Special Court has rejected the request of former Environment Minister Lefter Koka for release from prison.

The decision was made by Judge Erjon Bani, who did not consider Koka's request to extinguish the measure on the grounds that the 3-year detention period for the Fier incinerator has expired.

In July of this year, Koka won the right to conditional release from the Durrës Court for the Elbasan incinerator, where he was sentenced to 6 years and 8 months in prison with a summary trial.

Judge Xhevdet Lika said that for the remainder of the sentence, Koka must remain on probation and during this time must not commit any other criminal offenses.

Lefter Koka was sentenced in the first instance to 6.8 years in prison for the Fier incinerator, while he was sentenced to 2 years for the Tirana incinerator.

None of the decisions have become final in the Special Appeal. For the Fier incinerator, Koka claims that he has exhausted his sentence, with the time spent in detention, referring to Article 261 of the Criminal Procedure Code, point 1/C, which provides for the termination of the security measure.
