The vice-president of the Court of Appeal of the general jurisdiction, Valdete Hoxha, in an interview for the "Fol" center podcast, showed some of the cases of violations of traffic rules that end up in court.
Anila Hoxha: Judge Hoxha has 31 years in the justice system and of course she has judged cases from the most serious accidents in Albania to the review of security measures for violations of road traffic rules, starting from drunk driving , driving a vehicle while in possession of narcotics and for other violations provided for by legislation.
Valdete Hoxha: We must distinguish the cases of accidents resulting from violations of traffic rules, which can be a quick violation of the moment, regardless of the care the driver may have, from violations of the rules of the road. traffic as a result of the use of narcotics and alcohol. Many cases do not forgive themselves and understand that moment for them, one minute is fatal.
Anila Hoxha: And then the trials on the merits begin, that legal battle between the act of experts on the one hand, testimonies on the other hand, but also the need to have a statement from the family members of the injured party.
Valdete Hoxha: It's not just a problem with "he forgives you for committing this crime and he says I'm sorry", but in fact normalization also has to do with how he supports it, how this criminal offense affects people in terms of financing that the person can do in terms of their damage.
Anila Hoxha: What is the statement of the suspect who caused a car accident and confessed before the court and made a long statement that you remember?
Valdete Hoxha: There are many cases where an accident has occurred due to violation of traffic rules, wrong overtaking or speed exceeding the allowed speed limit. They have left a mark on their lives and of course the repentance is deep.
Anila Hoxha: The State Police declares high numbers of people arrested for driving drunk, especially on holidays, mainly on weekends or even at midnight. What do they testify before you?
Valdete Hoxha: I was at a family party. I was at a party. I was at a wedding. But of course you can go to a party, you can go to a wedding, you can drink, but in no way should you drink and drive personally. Better to take a taxi, because that minute is unforgivable both for the person driving the car and for the person who may have an accident. It is a phenomenon that many people got into the car in a drunken state. You can drink very little. It is not meant to be.
Anila Hoxha: Madam judge, what is the age group that is arrested the most for violating traffic rules?
Valdete Hoxha: The age groups are different, but in many cases there are also young people. In fact, I also had a family disaster, as my nephew had an accident. The pain is extremely great and I cannot describe it as his loss, but the pain felt by all family members (brothers, sisters-in-law, from which pain the sister-in-law unfortunately lost her life from this great pain. ). I urge you all that when you go out by vehicle, go out calmly, walk carefully and follow the rules to the end.
Anila Hoxha: On the other hand, it is true that we have accidents due to the fault of the driver. There are also many road axes that are officially identified as "dark spots", i.e. as sources of accidents. Have you examined in the judicial bodies also such cases, where the claim was raised that the road was to blame, it was the atmospheric conditions. Was it dark and the road was unlit?
Valdete Hoxha: We have had several cases when in fact the road signage was not good. In the places where there should be signage, if the roads are under construction, there should be signs to make it clear, you should be careful, you should reduce your speed, it is a turn, it is a road under construction. In fact, there have been cases where there was no such signage and there have been cases where such accidents have occurred. So the Road Authority must take measures. It is inexcusable that such cases occur due to road safety. So road safety is not at the right level.
Anila Hoxha: We have seen that the court never takes a break, not even for the holidays. Even on January 1 there are judges, even on the weekend there are judges. What about the first days of the year, mainly, which category are the suspects who come for personal security measures?
Valdete Hoxha: Mostly for drunk driving. There are also many without a license, use of narcotics and accidents. The end of the year also has accidents.
