Erjon Llapushi, convicted in absentia for the murder of waiter Gazment Kurmaku, has issued a lengthy public statement, in which he opposes the sentence for the criminal offense of "intentional murder".
He was sentenced to 17 years in prison by the court for the incident that occurred at Gjergj Luca's bar. In October 2021, Llapushi punched the waiter at "Rozafa Fish City", who then crashed into the corner of the table and died a few days later. Surprisingly, to this day, Gjergj Luca himself has not said a word about this incident.
In his statement, Llapushi states that he does not deny the tragedy and loss of the victim's life, but insists that he never intended to kill. According to him, the incident was the result of a single punch, without a weapon, without planning and without any previous conflict.
" I have been convicted of intentional murder. For an event where there was only one punch. There was no weapon. There was no knife. There were no hard objects. There was no plan. There was no ambush. There was no previous conflict. There was no previous acquaintance. There was no intent to kill. I am not saying that tragedy did not happen. It did. And that tragedy will weigh on me for the rest of my life. But I am saying that I did not kill intentionally. Will is not invented. Will is proven ," says Llapushi.
He says he is not seeking mercy, but justice, raising questions about how the charges against him have been qualified.
" I am not asking for mercy. I am asking for justice. I am not asking for favor. I am asking for the same standard as any other citizen. The family of the deceased, with all its pain, has accepted the normalization of relations with my family. This was done by notarial deed. This does not turn life around. It does not erase the pain. It does not make the tragedy disappear. But it shows something very important: those who had the greatest pain accepted normalization ," he declares.
Llapushi also raises accusations about the way he has been publicly exposed by the State Police, claiming that he has been treated as one of the most dangerous people in the country.
" The State Police publicly placed me among the five most wanted people in Albania. I ask publicly today: Was I the greatest danger to this country? Was I the man who should have been presented as a public enemy? How is it possible that serious names, rumored for crimes, for criminal connections, for dubious wealth and for influence over the state, are often not touched, while I was brought out in front of all of Albania as one of the most dangerous? ", the statement says.
He also demands verification of the role of the institutions in the investigation and trial, claiming that the process against him was unusually harsh.
" My case was initially registered for injury. Then, after the case was investigated by prosecutor Kreshnik Ajazi, the charge took the most serious direction: intentional murder. From that moment on, my family has felt an unusual intensity, an unusual persistence and a severity that did not match the real circumstances of the event. We have serious reasons to request institutional verification ," says Llapushi.
In the statement, he also addresses the allegation of wiretapping of his family's apartment, saying that his wife and minor children were also violated.
" Another serious wound for my family is the wiretapping in the apartment. In that apartment, not only did a name on the file live. My wife lived there. My four minor children lived there. When the state entered there, it didn't just enter my life. It entered the heart of my family. It entered the room where my children slept. It entered my wife's life. And today I ask: Who will be held accountable for this? ", he says.
In the end, Llapushi reiterates that he does not seek to evade responsibility, but demands that his case be handled according to the law and real circumstances.
