The vetting process for justice has been closed, but the doors of the Special Panel will remain open until June not only because of the mandate, but also because a new phenomenon is being observed, former dismissed judges and prosecutors are requesting a review of decisions based on the fact that two former members of the Special Panel of Appeals have been found guilty by the courts.
Of the 29 former judges and prosecutors who have so far requested a review of the decision without waiting for Strasbourg, the claims of 13 of them will be reviewed in the deliberation room this Tuesday.
The opposition of those dismissed, insisting on reopening the process in Albania, is directly related to two former judges of the Special Chamber of Appeal, Luan Daci and Ardian Hajdari, who were part of the KPA bodies that decided to remove them from the system.
But both of them are considered to have been appointed as judges without the law based on Strasbourg's position that, while vindicating former prosecutor Besnik Cani, emphasized that Daci had assumed the position of Vetting judge without his background being checked, meaning he could not exercise such a duty.
Former Vetting Judge Luan Daci was sentenced to probation in Albania on charges of falsifying documents after it was proven that during his competition as a KPA judge, he had concealed a dismissal decision from the former Supreme Court of Justice.
Meanwhile, another former judge, Ardian Hajdari, has appealed to the Supreme Court against the decision of the Court of Appeals that sentenced him to one year of probation for concealing assets. Every decision in which they participated is being challenged by review by the dismissed judges, who had previously reported them to SPAK for investigation.
The Vetting process lasted eight years and saw 805 judges and prosecutors go through the triple sieves, of which more than half were dismissed. This includes 442 subjects, of whom 268 were dismissed, 105 resigned and 49 were dismissed without a final decision.
With the closure of the Vetting, the staff moves to the Constitutional Court, where the constitutional judges will be the ones who will examine other review requests that will be filed by the dismissed, or possible Strasbourg decisions. / Top Channel
