Former prosecutor Ervin Karanxha has stated that SPAK should resolve the case of judge Irena Gjoka once and for all.
Karanxha said that if Irena Gjoka is convicted and has lied on the form, she should be prosecuted.
"For me, the case of Irena Gjoka is a shameful case. Now, a criminal decision is being discussed that was sentenced in Janina. SPAK must resolve this issue. Was she convicted or not? The lawyer comes with a decision and says "here you go". In Janina, people are going for coffee. This issue should be separated. Because when we investigate a decision whether it is years old or not, it makes no sense. It is not a complex issue. This issue is resolved. If Irena Gjoka is convicted, she lied on the form, she has a sentence, that is, she is liable to be prosecuted, she loses the status of magistrate and she is liable for lying when she started working.
If you lied and are convicted, the decisions are invalid, because Article 128, the first paragraph of the Code of Criminal Procedure states that decisions are absolutely invalid when they have come from a court not established by law, because the law must be respected.
