The lawyer Brisida Gjikondi says that Sali Berisha flagrantly violated the decision of the GJKKO on the 'house arrest' measure, communicating from the balcony with a microphone.
In an interview for "Tirana Live", Gjikondi emphasized that Berisha's continuous violations constitute a reason to send him to prison.
"It was a flagrant violation of the decision of GJKKO and the procedures that have been taken so far against Berisha. The decision is clear, where it justifies that communication with others except family members is prohibited. He ignored this point but also took a microphone. He did not consider this part of the decision at all, as if no institution of justice and legal procedure has been considered, despite the fact that until it is decided that he is guilty, he is presumed innocent. He has abused this legal basis and violates and violates the reputation and dignity of Albanian justice institutions. Article 237 of the Code of Criminal Procedure, 'house arrest' is defined in the court decision on how to proceed. He has written that he is not allowed to communicate with anyone. But the police have the task of verifying whether Berisha has properly respected the decision and make a report on the violations he has committed, which constitute a reason to change the measure of arrest to prison arrest," said Gjikondi.
She said that Berisha can stay at home for up to two years.
"He can stay at home for up to two years. I have said that Berisha is the most characterless being and he says differently and does differently. Here he acts like a hero who doesn't ask about justice and secretly takes lawyers here, recognizes him and tries to appeal the measure of arrest for compulsory appearance. I heard Balla, but the state police, as one of the institutions responsible for the verification of Berisha, has the duty to make a report on the violation he committed. If we continue to tolerate characters like Berisha, others have the right to do the same. The law has criteria, but also what is done when this gentleman violates these," added the lawyer.
