The former mayor of Memaliaj Municipality, Gjolek Guci, has been indicted by the Special Prosecution Office (SPAK) for the criminal offense of "violation of equality in tenders".
It is learned that along with him, citizens Edmonda Harizi, Bersant Ylli and Feta Hoxha were also taken into custody, who are suspected of being involved in the same illegal procedure.
Investigations have identified violations in a procurement procedure related to a water supply project in 8 villages in the area.
The investigations began after a report by the Supreme State Audit Office in October 2024 and focus on the procurement procedure for the "Construction of the Regional Water Supply" for several villages and the city of Memaliaj, with a fund of over 493 million lek.
According to the prosecution, the former officials, in collaboration, created unfair advantages for certain economic operators by declaring a consortium of companies that presented deficiencies in documentation, especially in technical capacity, as the winner. In addition, subcontracting was allowed to a company that had a conflict of interest, after it had donated the project and drafted the technical specifications.
Gjolek Guci has led the Municipality of Memaliaj for several terms, until the last local elections, when the candidate of the opposition coalition "Together We Win", Albert Malaj, won with a margin of 312 votes.
According to reports, there have been other complaints against Guci from citizens and the Democratic Party, while investigations into the matter continue.
SPAK announcement
The Special Prosecution Office against Corruption and Organized Crime completed the investigations and has sent to the Special Court of First Instance the request for the trial of criminal proceedings no. 216/1 of 2024, against the defendants:
Gjolek Guci, ish-Kryetar i Bashkisë Memaliaj, i akuzuar për veprën penale “Shkelja e barazisë së pjesëmarrësve në tendera apo ankande publike”, kryer në bashkëpunim, e parashikuar nga nenet 258 dhe 25 të Kodit Penal (përpara ndryshimeve me ligjin nr. 43/2021, datë 23.03.2021);
Edmonda Harizi, ish-Nënkryetare e Bashkisë Memaliaj, e akuzuar për të njëjtën vepër penale;
Feta Hoxha, ish-Drejtor i Shërbimeve Publike pranë Bashkisë Memaliaj, i akuzuar për të njëjtën vepër penale;
Bersant Ylli, administrator i subjektit “Bersant Ylli”, i akuzuar për të njëjtën vepër penale.
Hetimet kanë nisur mbi bazën e kallëzimit penal të dërguar nga Kontrolli i Lartë i Shtetit më 28.10.2024. Për këtë qëllim, më datë 04.11.2024 është regjistruar procedimi penal për veprën penale “Shkelja e barazisë së pjesëmarrësve në tendera apo ankande publike”.
Objekt i hetimit ka qenë procedura e prokurimit “Ndërtimi i Ujësjellësit Rajonal për fshatrat Vasjar, Iliras, Qesarat, Anë-Vjosë, Toç, Lulëzim, Zhulaj, Krahës dhe qytetin Memaliaj”, e vitit 2021, me autoritet kontraktor Bashkinë Memaliaj.
Nga hetimet ka rezultuar se Kryetari i Bashkisë Memaliaj, shtetasi Gjolek Guci, më 21 shtator të vitit 2020 ka nënshkruar kontratën e dhurimit me nr. 658/1 Prot., me operatorin ekonomik “Artreum Generation” sh.p.k., të përfaqësuar nga administratori A.Sh. Ndërsa projekti për zbatimin e ndërtimit të ujësjellësit rajonal është miratuar nga Kryetari i Bashkisë Memaliaj.
Fondi për objektin, në vlerën mbi 493 milionë lekë (493.183.572), ishte ndarë në zëra për ndërtim, montim, drejtimin dhe kolaudimin e punimeve. Vlera e miratuar ishte e njëjtë me vlerën e kostove në projektin e dhuruar nga shoqëria “Artreum Generation”, nënkontraktore e njërës prej kompanive fituese të tenderit.
Pas analizës së dokumentacionit të procedurës së prokurimit, është konstatuar se anëtarët e Komisionit të Vlerësimit të Ofertave, shtetasit Edmonda Harizi, Feta Hoxha, Bersant Ylli dhe titullari i autoritetit kontraktor (Bashkia e Memaliajt), shtetasi Gjolek Guci, në bashkëpunim me njëri-tjetrin, kanë krijuar avantazhe dhe privilegje të padrejta për operatorë të tretë, duke kualifikuar dhe shpallur fitues bashkimin e operatorëve ekonomikë “KEG” sh.p.k. & “ED Konstruksion” sh.p.k., të cilët kishin mangësi në dokumentacionin e paraqitur, veçanërisht në kriteret për kapacitetin teknik.
Gjithashtu, është pranuar nënkontraktimi me operatorin ekonomik “Artreum Generation” sh.p.k., i cili ndodhej në kushtet e konfliktit të interesit, pasi kishte dhuruar projektin dhe kishte hartuar specifikimet teknike dhe nuk plotësonte kriteret ligjore për nënkontraktor.
Në datë 28.01.2026, është vendosur ndarja e procedimit penal nr. 216 në procedimin penal 216/1, për hetime të mëtejshme lidhur me zbatimin e kontratës, për të cilën kërkohet kryerja e veprimeve hetimore të mëtejshme.
