The businessman in December 2023 and the other persons arrested as part of the Metamorfoza operation requested their freedom in the Supreme Court.
Gjoka, Edmond Preka, Ardrit Hasanbegaj, Xhevahir Lita and Oltian Bistri filed an appeal to change the decision of the Special Court that imprisoned them.
SPAK is investigating them for various charges from murder, to the preparation of assassinations in Tirana and Shkodër, as well as corruption and abuse of office.
Pëllumb Gjoka was arrested as part of a criminal group after the breakdown of communications in SKY ECC, he was also announced as a strategic investor, meanwhile 390 thousand square meters of land on the beach of Velipoja were seized at the request of SPAK.
SPAK has raised suspicions that these land areas were obtained through forgery.

Pëllumb Gjoka is the owner of several companies with activity in the field of investments in tourism and gambling, in addition to other businesses. But while the public authorities, including the Council of Ministers, were working feverishly at the service of the strategic investor, Gjoka is suspected of ordering murder.
He is currently charged with "Premeditated murder", committed as a special form of cooperation, that of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a structured criminal group and criminal organization". According to the police announcement, this charge is related to the murder on August 9, 2020 of the citizen Gj. N. (B.). He is also accused of two cases of the criminal offense of "Providing conditions and material means to commit murder" as well as active corruption of the prosecutor.
The members of the group are accused of 12 criminal offenses, including murder, illegal deprivation of liberty, drug trafficking, money laundering, committed within the framework of the structured criminal group. While the arrested officials are accused of corruption, abuse of office and fake expertise.
