SPAK dismisses Berisha's request: It is not allowed to go to the Assembly

SPAK has rejected the request of former Prime Minister Sali Berisha to participate in the plenary sessions.

Through an announcement, it is reported that the special prosecutors have decided not to accept the request filed by Berisha's lawyers, who is currently under house arrest under the charge of passive corruption for the privatization of the 'Partizani' complex.

"The person under investigation Sali Berisha (represented by his defenders Sokol Mêngjesi and Genci Gjokutaj) filed on 15.01.2024 a request by which he requested his permission to participate in the plenary sessions of the Assembly, in the capacity of MP. After getting acquainted with the content of this request, with the decision dated 18.01.2024, the prosecutors have decided not to accept it", says the announcement of SPAK.

We recall that Berisha's lawyers addressed a request to SPAK prosecutors on January 15, stressing that this is a constitutional right.

Another argument accompanying this request is the fact that there is no final decision against Sali Berisha.

"In the conditions when Sali Berisha is a member of the Assembly, chosen by the sovereign, it is necessary for him to exercise his functions as a Member of the Assembly. For this reason, since you are the prosecuting body, we ask for your approval and permission that Mr. Berisha in the manner and time that is absolutely necessary to go, participate and exercise his functions in the plenary sessions of the Assembly in fulfillment of the political rights and freedoms provided by the Constitution of the country, but also to fulfill his obligations towards the electorate who chose him", it was stated in the request of the lawyers.

On December 30, 2023, the Special Court against Corruption and Organized Crime decided to replace the security measure with mandatory house arrest under police supervision against former Prime Minister Sali Berisha, a person under investigation for the privatization of the former Partizani sports complex.

The decision was taken by judge Irena Gjoka, president of this court, for which Mr. Berisha's lawyers had asked to be excluded from the judging panel, claiming a conflict of interest.

The Special Prosecutor's Office against Corruption and Organized Crime requested an authorization from the Assembly to strengthen the security measure against Mr. Berisha, because he refused to comply with the first measure, calling it unconstitutional, for several weeks in a row.

The Special Court ordered MP Berisha not to leave his apartment and not to communicate with other people except those who live with him in the same apartment, while for the implementation of this measure it charged SPAK and judicial police services.

According to the procedures, police supervision foresees regular services near Mr. Berisha's apartment to follow his compliance with this measure.

Mr. Berisha's lawyers said that this decision will be further appealed within the legal deadline, but the communication restrictions for a deputy are, according to them, illegal, because they had to be done with an authorization from the Assembly.

The former prime minister under investigation, Sali Berisha, is suspected of passive corruption in cooperation with regard to the issue of the privatization procedures of the former Partizani sports complex, during which SPAK suspects that he has exerted influence and pressure with various acts, favoring the son-in-law his Jamarbër Malltezi, one of the owners of that land, which was quickly filled with a group of buildings.
