The High Court is expected to review on May 28 the appeal filed by Mayor Erion Veliaj, who requests the replacement of the security measure "prison arrest" with a lighter measure.

Veliaj has been held in prison custody since February 10, 2025. SPAK has filed 13 charges against him, including passive corruption, money laundering, failure to declare assets, abuse of office, and bringing prohibited items into prison.

His request comes at a time when the Joint Panels of the Supreme Court have reviewed a 2011 unifying decision regarding the security measure "prison arrest" and its duration.

The new decision, taken unanimously, stipulates that the most severe measure of restriction of personal freedom should be imposed only after other security alternatives have been previously considered. It also requires a detailed justification for each specific case, while the burden of proof lies with the prosecution to justify the need for imposing the extreme measure.

"It is requested that the security measure "Arrest in prison", provided for by Article 238 of the Criminal Procedure Code, be replaced with a milder security measure such as "Property guarantee" provided for by Article 236 of the Criminal Procedure Code or "Obligation to report to the judicial police", provided for by Article 234 of the Criminal Procedure Code",  states Veliaj's request.
