New Criminal Code, EU reacts: We were not part of the drafting, consult with all

The European Union reacted today to the new draft of the Criminal Code presented last week by the heads of the country's justice system.

The EU confirms that it was not part of the expert group during the discussions on drafting the provisions of the Criminal Code, but emphasizes the inclusive process that should accompany its adoption.

"Given that the general revision of the Criminal Code is an important and complex process, with a potential long-term impact on society and the justice system, the EU underlines the importance of ensuring a comprehensive and full consultation with all key justice institutions and rule of law actors, as well as civil society, to guarantee the highest quality of the legislation to be adopted," the European Union statement said.

At the same time, the EU encourages Albania in the short term “to give priority to legislative changes that are necessary to meet the intermediate standards set out in the EU Common Position on Chapter Group 1 (Fundamentals). The EU stands ready to provide technical assistance in this regard”.

Chapter Group 1 (Fundamentals) includes 5 important chapters dealing with Justice and Fundamental Rights, Financial Control, Statistics, Freedom and Security, and Public Procurement.

This Chapter Group also contains additional criteria related to the functioning of democratic institutions, public administration reform and economic criteria.

"The European Union has received notification of the presentation of draft amendments to the Criminal Code, the result of the work of a group of experts commissioned by the government.

The European Union was not part of the expert group and does not yet have a position on these draft amendments.

Given that the general revision of the Criminal Code is an important and complex process, with a potential long-term impact on society and the justice system, the EU underlines the importance of ensuring a comprehensive and full consultation with all key justice institutions and rule of law actors, as well as with civil society, to guarantee the highest quality of the legislation to be adopted.

As part of the European Union accession negotiations, Albania is expected to amend a number of specific provisions of the Criminal Code to align it with European standards and EU legislation. In the short term, the EU encourages Albania to give priority to those legislative changes that are necessary to meet the intermediate standards set out in the EU Common Position on Chapter Group 1 (Fundamentals). The EU stands ready to provide technical assistance in this regard," the full response states./TCH
